Thank you, Lord, for this great county and this great city and all the men and women that work so hard to make it that. Father, we thank you that you've provided for us. That God, you've seen to it that we have the resources needed to succeed. Thank you, Lord, for our laws and our civic duties and all that you've enabled us to do. Thank you, God, for continuing to bless this land, to bless this place, and to bless this people. In Jesus' name, Amen. And now, to say our pledge, I have three young ladies from the fifth grade at Wall Elementary. If y'all would, please come forward, I'll introduce you. We had here, this is Nicki Sale, we had Emily Green, and we had my granddaughter, this is Aaron Elizabeth Morrison. They're all fifth graders at the Wall Elementary. I've watched these little girls play football football. Basketball and volleyball for the last four or five years. They're not only excellent, excellent ball players.

I pledge allegiance to the flag out of the United States of America and to the flag for which it stands, one nation under God, indivisible with liberty and justice for all. And the Texas flag. I pledge allegiance to thee. Texas, one state under God, blind and indivisible. You may thank Jelly and Small, but you put a basket ball in that girl's hand, she's 10 foot tall and bulletproof. We have another thing this morning that I'm going to introduce this meeting. I've got seven meetings left before I ride off into the sunset. And since my job primarily as the mayor is to support my town, to be a cheerleader for my city, and to promote the citizens in our city and the abilities and the talents that they have, I have decided for the next seven meetings, I will start our meetings off with some local homegrown musical talent from the city of San Angelo. And we have more talent in San Angelo than probably anywhere else in the state of Texas. Now, I know that Austin is 20 times as big as we are, and people flock to Austin. We raise our own here, and we've got some tremendous talent. To start us off this morning, I've got Case Hardin. Case Hardin was born in San Angelo. He graduated from Central. He is now at ASU. He has several CDs out. He is a, he is an extremely talented musician. Case is, I think he's playing out the rodeo this week,

All right, next on our agenda is the public comment where we allow anyone in the audience that wants to make a comment. This is your opportunity to come forward and to say whatever you want to say to the council. I will ask you to keep it to about three minutes, and Brian, I will ask you to run a timer for us today. Keep it on about three minutes, please sir. Let me read the legalities. issues or items that are not on the agenda, excuse me, may be raised by the public at this time. Citizens should speak from the podium began by stating their name and limit remarks to about three minutes. Council members may request that a discussed item be placed on a future agenda. The council takes public comment on all regular agenda items

I would ask you now, if you have something you wish to address the council, this is your time and your opportunity, make a line at the front. ask you to introduce yourself, and you've got three minutes, sir. Good morning, my name is Wayne Dolcefino. I'm president of Dolcefino consulting. We are an investigative communications firm based in Houston. Nice to see all you. I'm sorry that Ms. Farmer could not join us this morning because I was hoping that she could provide us with this mysterious audit from Republic that she had seen that nobody else in the world seems to have seen. My company is really based on a notion of transparency in government. I was a reporter for 27 years for ABC. And during that time, I had the pleasure of investigating Republican and uncovering a plot to defraud taxpayers of the city of Houston for several million dollars. So I have some experience with garbage companies. I think it's very important for public officials to tell people the truth, regardless of who you choose to do business with. No contractor, no contractor should dictate to the city, Mr. Valenzuela, what documents they will show you and what documents they will not. If it was not an audit done of Republic Ways, simply tell the home folks. When you did your new contract, whatever company you chose, there were three safeguards that were included to sort of calm down the opposition. One was this notion that Republic would be fully audited. The city would follow through, Mr. Valenzuela, you made those comments, you didn't do it. Tell people the truth. Second, that Republican refunded $6.3 million to the various businesses in San Angelo. There's no evidence the city ever fallen up, and from what I understand, the Republican now refusing to tell you, look at your contract.

[0:16:25] You have a right, in fact, I would argue you have an obligation to the citizens to enforce that contract and make them. The third was a contract compliance officer so that you could watch this contract. And whether it's garbage or whatever, you have a contract compliance office whose full-time job is to watch Republic. I asked for any evidence of an inspection or an audit of that facility in the last two and a half years, and there are none. I looked at all the emails and the records, and there is no evidence at all that anyone here is reviewing the itemized bills. Now, that's just not right, and it's not fair to these people. I don't live in San Angelo. Obviously, I have some new found friends here, but I'll go anywhere to tell government officials that mistakes happen. Things sometimes aren't followed up in a bureaucracy, but just tell people the truth, and then follow that up with enforcement. You have a big contract with any contractor. You have an obligation, I would argue, to make sure they have followed the rules. these people out here deserve it. Some of them are too afraid to say something, I'm not. Thank you very much. I have any other public comment this morning. This is your opportunity if you'd like to address the council. Good morning. Good morning, mayor, city council. My name is Sharon Hoffman. I'm a volunteer with Critter Shack, which is an all-volunteer, non-profit, rescue, spay-neuter organization here in town. One of our ongoing programs is working with community cat caretakers here. I wanted to tell you what we and many of the caretakers have been doing for the last two years since the TNR, the Trappenator Return Ordinance, was passed almost two years ago. With the added protection that the ordinance gives these caretakers, we have seen increased activity and spaying during vaccinating community cats in a growing effort to educate people about the benefits of TNR.

[0:18:27] cats or cats that are pets that have been abandoned or lost, the offspring of those cats, it also applies to time cats that are allowed to roam freely. For years, the way people dealt with community cats was to kill many of them. They were often shot, poisoned, or taken to a shelter to be killed. These controlled methods are often inhumane and are illegal, and most importantly, do not offer any long-lasting solutions. The number of cats may be temporarily reduced, but soon more are born, more dumped into these colonies and the numbers quickly begin to increase. When cats are removed from a colony, the vacuum effect goes into effect, allowing the entrance of new cats into the area and the survival of more of the offspring of their remaining cats. Quickly, the vacuums field and the cycle starts all over again. The stable colony of cats actually repels new thermocats and protecting their colony and their food source. Gravity return is a non-lethal massive population control that's much more effective than trapping kill. Advocates, humanely trapped community cats and kittens have them neutered and vaccinated by veterinarians. Extremely sick cats are often used in us. Adult, healthy, unsocialized cats are returned to the colonies and adoptable cats in kittens are adopted out and placed into good homes. That's a very important part of this program. Reading stops, populations are gradually reduced, not overnight, very gradually. The annoying behaviors of reading cats, yelling, fighting, spraying, stopper, decrease. The cats are vaccinated against disease and actually serve as a barrier against wildlife that might be infected with rabies. I always say if you like cats, TNR makes a lot of sense. If you don't like cats, it really makes a lot of sense because it results in fewer numbers of these cats. It's the only effective long-term method reducing community cats is humane. Smaller numbers of cats, healthier colonies, humane treatment of animals. I believe these are all goals that we can all work for. Thank you.

[0:20:28] Thank you. That's Hoffman. Good morning. Good morning. I'm Lloyd Pascal. I am also a volunteer with Critter Shack besides my other job. I'm in the microphone. I'm sorry. Oh, okay, sorry about that mayor. As I said, my name is Lloyd Pasco. I am also a volunteer with Critter Shack and have been practicing the TNR in my area of town. But also I was asked to talk about, you know, that, you know, this program takes volunteers who believe in the implementation and it takes time and it takes money. Cities like Dallas, Arlington, Waco, San Antonio and Austin have offered assistance with the spay and neuter and they have seen remarkable reductions in the number of community cats. San Angelo is very fortunate to have many wonderful care takers who work every day to care for and properly vet these community cats using their own money or money they raised with fundraisers or donations from friends or rescues. Critter Shack offers a low-cost community cap program at our Spade Nutter Clinic and many caretakers are taking advantage of the opportunity to Nutter invent their colony cats. Once or twice a year Critter Shack schedules a free or very low-cost community cat clinic on a Saturday or on a weekend. Since the ordinance was passed we have spayed or neutered nearly 400 in those weekend clinics. At our regular clinic, we have vetted another 1,000 in the last year and a half. We called several of the area vet clinics, and their numbers vary, but they neuter between 50 and 300 cats per year. Dr. Grove in Crystal Hole has some funding and even sets traps by the river.

[0:22:36] She goes on her lunch hour and retrieves the traps, neuters and vaccinates the cats, facilitating an amazing TNR program. Besides vet work, we help caretakers adopt out their socialized cats and kittens, and we try our best to educate people about TNR. The passage of the TNR ordinance, the cooperative efforts of responsible colony care takers and rescue, properly vetting of these cats and the effort to educate people about TNR are all very good beginnings to addressing issues with the colony cats. Thank you, ma'am. Thank you. Good morning. Morning, Mayor Maris Morrison and City Council. Is this good? My name is Kristen Stanley. I'm here today to give you an update on our work stabilizing and reducing community cats in San Angelo and surrounding areas. Two years ago, ASU President Brian May spoke to this body on behalf of Trapp Nuter Return as the best solution to address the community cat population. Dr. May spoke to the City Council encouraging the use of TNR as the only effective solution. He knows as Angela State University has the ASU Cat Coalition. Dr. May reminded us, euthanasia is never the answer. Within five years through TNR adoption and attrition, the ASU cat coalition has safely and humanely reduced the cat population by over 60% from 120 cats to 52. We have prevented over 70 litters and subsequent litters on campus. With the help of Critter Shack rescue as a partner, we found forever homes for 77 of these cats that were most likely abandoned are strays that made their way onto campus. In less than two years since the TNRM, a free-roaming community cats ordinance was passed,

[0:24:38] Critter Shack rescue volunteers have reduced the population of a local park by 50 percent, from 62 to 32 cats, and adopted 15 of these cats and kittens into good homes. For TNR to be effective citywide, it must be practiced not only in colonies, but on every block in every neighborhood. In the last year, Critter Shack has witnessed dozens of people becoming actively involved to help community cats in their neighborhoods by becoming educated and by beginning to practice TNR. We asked for the ordinance to give a safe legal space to practice TNR, and for that protection we are truly grateful. Critter Shack is the only sponsoring community cat organization under the ordinance has worked for the last two years to provide low cost spay nooder services for area citizens. Many of these citizens are elderly on fixed incomes. When unsocialized cats enter the shelter, they take up valuable space for adoptable animals and are later euthanized at taxpayer expense because they are not adoptable. There's a core group of community cat takers, advocates, supporters who devote considerable time, money, and other resources to trap, neuter, return, and maintain. This core group is instrumental in keeping hundreds, if not thousands, of cats and kittens out of the San Angelo City shelter system, thereby saving taxpayer dollars. Animal services has a huge job and it must balance multiple priorities. City Council determines those priorities, and I would like to encourage everyone of you to embrace your private partners who contribute significant time, money, and other resources in managing and reducing St. Angelou's community cats. Thank you. Thank you, ma'am. Good morning. Morning. I'd like to thank you all for the opportunity to speak. I'm going to talk again about trap new return

[0:26:38] and the St. Angelou State supported Living Center. Start with the name. Got your own television. My name is Deanna Fletcher, and I work in the rehab department at the St. Angelou State Support Living Center. In April 2016, a colleague of mine meant with administration to talk about the Cat Over population on campus. In one month, we had over 11 cats born just outside our building. We presented some statistics about trap new to return, success stories from other communities, and some ideas about how we could bring in a program to improve the overall health and reduce the number of cats on campus. In the last 10 months, administration has been working closely with us, and we've had good progress. Our program is called Feline Friends Project, named as such because we have a symbolic relationship with the cats. We provide food, water, medical care, vaccinations in Spain, Newter, and the cats in turn deter snakes and control rodent infestation. With eight of critter shack and a number of employees, we are able to alter and vaccinate two cats a week. Since inception, we've altered 76 cats, 25 that have been removed and placed in good homes, 32 of the 76 are female. With each female having the potential to have two to three litters a year, we've prevented over 60 litters of cats in just this last year. In order to support the cats on campus, we have set up four food and water stations. It's important to note that these feeding and water stations are built and cared for by the intellectually and developmentally disabled individuals who live there. This created paid jobs for them that teach them valuable skills as well as compassion for living things. In order to teaching our residents, we also educate the staff about the benefits of TNR. The State Support Living Center has over 900 employees, and we frequently receive phone calls about how the employees can start a program just like ours on a smaller scale in their own neighborhoods. People are fitting from this information and sharing with others. The trap data return projects in town are still in very early phases, but we are seeing impact.

[0:28:38] We need to continue to educate the public and provide resources. To have a long lasting effect on the community cat population, it will take years of dedicated citizens public education and the support of local governing bodies. We know this is going to be a slow process. You can't alter an entire colony overnight. You have to start one by one or in our case two by two. We are prepared to do our part to continue to educate the public and provide services, but we need your continued support of colony caretakers with the trap-nator return ordinance. Thank you very much. Good morning. Good morning. My name is Ed Richmond and I'm a real estate investor here in St. Angelo. I came to the city about six months ago. Are you dealing with your like lot? No, this is separate. I'm here to say thank you. I actually owned 15 North Monroe and across the street from me for the last three years there was a house that had burnt and was in a shelled up position. I came to the city and talked with Mike about that and the fire marshal and I came through was looking through my properties yesterday, you guys have increased the safety of the property and you level that house. I wanted to say thank you for making my neighborhood safer and making it a more pleasant looking neighborhood for me to actually have my rental property. Thank you. Thank you, sir. Who's next? I have nothing to pull, but since Charlotte's not here, I'm gonna promote her town hall meeting on Thursday at six right here in the council chambers to speak about HEB and that surrounding area. Excuse me, I have nothing to pull, but I want to say I'm not a sports friend, but I watch that whole super game. Super ball games. I had to turn it off after that last two point conversion. I could not watch anymore. I knew exactly what was going to happen. I was also going to make the announcement for Charlotte. She is at a meeting in Austin right now with ports to planes and was unable to make it. And Marty had had a business thing that he had to be at, so he is not able to be here today as well. I did get an email yesterday from Joey, the, I'm going blank, I can't remember, Ashbrook. The band director at Central High School. Central High School will be representing the city of San Angelo in Memorial Day Parade in Washington, D.C. in May. So I'm extremely proud of our band, and the community has got behind these young students, and they've raised money. It is a goal. They are ready to take their entire band and all of their equipment to Washington, D.C., and represent our state in the Washington Parade. I wanted to say thank you to our Bobcat Band, and for the citizens, it made it possible.

[0:32:39] Also in the email, they went to contest on Saturday, and I think that there were 28 members that were able to win in their particular contest. And we had two members of the Bobcat Band that made all state. So they will now be going to Austin in the near future. They did make the all state band. And Brian, I'll get you some names, but I would like to have a recognition and have those two students brought in to recognize them publicly. Lane. All right, we are now ready to take up item number one on the regular agenda, which is the presentation on the Mayor's Wellness Partnership by Texas Hunger Initiative Representative Betty Tester. And we'll both come forward. Good morning to you. Good morning. How are y'all today? Well thank you. We wanted to talk to you just a little a little bit about the Texas Hunger Initiative and our San Angelo region, the Texas Hunger Initiative. Oh, I'm sorry. Mary Herbert, I'm the regional director for the Texas Hunger Initiative. And the Texas Hunger Initiative has offices in seven other communities across the state of Texas. Our home office is in Waco. We are a part of Baylor University. But we are very concerned about hunger in the state of Texas. And if we would ask most people in San Angelo, do we have a hunger problem in this community? I think most people would say that we do not have a hunger problem. But I wanted to show you some statistics that indicate that we do. 16% of people live in food insecure homes. These figures are coming from the Feeding Texas statistics that they put out. 16% of people live in foods insecure homes. That means that they do not know exactly where or if they were going to have enough food to have three meals a day, or where their next meal is coming from. 25.8% of the children live in these homes. That's 6,770 children that are at risk of hunger. Also, not listed on the slide, but one in six senior adults are also at risk for hunger. So the Hunger Initiative, the big key word that we would probably say for our organization

[0:38:48] is collaboration. It definitely takes all of us working in our community together to be able to solve this problem. We are working to ensure that all Texans have at least access to three nutritious meals every day. And also to raise education and awareness about the fact that we do have a hunger issue in our community and in our state. Our next big emphasis is going to be to create hunger-free communities in our whole region. Our region does cover 23 counties, so we're outside of – we are located – our office is located here in San Angelo, but we do have interest in other counties around our area as well. We also have, besides this, we, in a way of educating our community. We have our West Texas Hunger Summit, which we've come before to you all to talk about. We, our Hunger Texas, our Tom Green County Hunger Coalition was established in 2010. And we did that along with the establishment of our Kids Eat Free program. And I think most of you are probably familiar with that program to alleviate childhood hunger during the summer months when a school is closed and there is no, the children cannot eat at the school cafeteria. We've also created a community garden at Fort Concho thanks to cooperation with the city and that endeavor and we have some renewed interest of community members that are interested in raising their own food and having fresh vegetables and fruit. We have also done health and wellness task force. Our Hunger Coalition is kind of an umbrella organization, and it has these different task force under it. And so we're always looking for new and different ways that we can address the issue of hunger. Hunger impacts all areas of our lives, from education to physical and mental health.

[0:40:53] So we need everyone to help us. And I want to turn it over now to Betty Testin, who's going to talk to you a little bit more about the mayor's wellness. My name is Betty Testin. I'm the Child Hunger Outreach Specialist with the Texas Hunger Initiative Regional Office here. This task force group through the Tongering County Hunger Coalition came together as a result of that one summit we had. Everybody was very energized and we left all encouraged to see what could we do to make our community healthier. And so we have created the mayor's wellness partnership. We have our mission to exist to encourage, educate, and empower the community through programs that promote a healthier body, mind, and spirit. And then our vision is working toward a healthier and vibrant community. And this kind of aligns, or it does actually align with our Fit City grant here. And we've had our City Parks and Rec as well as our City Health Department, Sandra Villarreal, part of this task force helping us just kind of look at what we can do. We have other major stakeholders that have come to the table to work with us in this endeavor that we attend monthly Wellness Wednesday meetings. It's open meeting every first Wednesday of the month. We meet over at St. Paul Presbyterian Church and Network and share ideas. And these are just some of the folks here that have been major players besides the city, the community hospital health club as well as Shannon Health and Wellness, the Texas A&M AgriLife Extension and our West Texas Rehab. And then we have some others that are continuing to join us, but these are kind of the major ones that have brought us to where we are today. We want to tell hunger to take a hike. We want to kick off this mayor's wellness partnership with a walk. It is scheduled for Sunday, March 19th over at Kirby Park. We have such great parks in our community, so we thought what better way to get our citizens out and walk and encourage them to take part. And in addition to this, we want to ask people to bring a food item. our kids eat free summer meal program, the food bank here has done some Friday food bags,

[0:42:54] but we want to continue to help support that and increase that amount of foods that we can give out on those Friday for the weekend bags for those children in that program. So we're going to need to all work together to achieve a healthier, hunger-free community. We've partnered with, I said, the Texas AgriLife. We have Walk Across Texas. They have this phenomenal program that's in place. very easy to implement and they're going to be helping coordinate that for us and we just need 18. We've got a whole team sitting right here. Mayor Morrison said he's going to help support us. Maybe he'll be our team captain. I'm there. B is the Bell Street Construction Project update, Russell Pail, you have the floor, sir. All right, thank you. Good morning. It's here to give you a brief update of where we're at with the Bell Street Reconstruction Project.

[0:44:56] Just to remind everyone, the extents of the project are going to be basically from Rio Concho Drive to Old Ballinger Highway, which is approximately two miles long. And we're going to be looking at new pavement designs, new curb and gutter. Some of the different options that we're considering are of course asphalt pavement versus roller compacted concrete. The roller compacted concrete we've used on some of our other streets like 50th Street and up around the Colosseum. It's proven to be a good product but you know it's a little more expensive than asphalt so it's some options that we have to consider though, you know, as well we're also looking at replacing our water and sewer mains that are within the Bell Street or underneath Bell Street. We'll definitely be moving the water lines from, you know, out from underneath the street to behind the curb. You know, we've got a pretty large water main in that area to approximately or it's a 16-inch water main and most likely be leaving the sanitary sewer where it's at but just doing some rehabilitation measures just to ensure the longevity of that sewer main. We'll also be looking at our traffic signals and that area we'll be adding, you know, brand new traffic signals that'll have the protected left-hand turns, movements, very similar to what we have on Sherwood Way, where it flashes, you know, yellow instead of just a solid green or whenever it's a you know we had to yield to oncoming traffic just to make it a little safer. We'll also be adding side walks the entire or this entire length of Bell Street or at least from Rio Concho Drive to Loop 306. We do have some issues with with the

[0:47:01] sidewalk, you know, with the amount of right-of-way that we have, and that has been one snag in this project as far as, well, actual right-of-way that we have available for Bell Street. What we found or what our engineering firm that's working on this has found is that some of the right-of-way or property adjacent property lines actually extend out into Bell Street. So what we're going to be doing is approaching, or when we've already started the process, of of approaching adjacent property owners to look at acquiring that right-of-way or easements, things of that nature just kind of depends on the situation where it juts out because none of them are very consistent, some of them extend five feet, some of them extend 10 feet. So it's just kind of a give and take scenario. So in two with the sidewalk, we can kind of do some adjustments, you know, in our design to accommodate with what we do have, you know, we can either make the sidewalk a little narrower or push it up closer to the back of curb, but more ideally we want to have it, you know, a couple of feet off of the back of curb just to make it a little safer feel, have that safer feel whenever you're walking up and down Bell Street on the sidewalk that you're not right up against moving traffic, things of that nature. Bell Street's gonna be broken up into three phases. Phase one is going to be from real contral drive to Harris Avenue. Phase two will be from Houston Hart to old Ballinger Highway. And the reason for having phase one and kind of on the far south end and then the phase two on the far north end depends on you know how we you know who bids on it how who actually gets the bid awarded to them it could have some potential conflicts there with you know if we had two different contractors you know we're just trying to alleviate that as well as traffic congestion whenever we're

[0:49:04] working and you know have you don't want to have the entire stretch of Bell Street torn up at one time and to just try and alleviate some of those you know pressures for you know having construction going on and just being able to still move through that area. One thing to that we'll be looking at or coming to the council in the near future is potentially decreasing the traffic speeds on Bell Street just for the construction phase just to make it safer to make it safer not only for our construct contractors but you know for the traveling public through that area you know we want to you know it's a lot just like text dot text dot typically decreases the traffic through a construction zone you know we need to look those same things to keep everybody safe and help construction move along as expedient as possible. Currently, we're finishing up phase one of the design, we you know we have the engineer working on the entire three phases but you know as of course we want to get phase one done as quickly as possible but like I said But again, the hold up there is the right-of-way acquisition. Our engineer is also working with our franchise utilities as well as our own utilities. The gas lines and the electrical lines that are in the right-of-way, we just need to make sure that those aren't going to be an issue as well. We've been in contact with them early on throughout the design phase of this project, and they're well aware of where we're moving in. Anyway, construction for phase one we're anticipating will begin this summer but a lot of it depends on right-of-way acquisition and and how those deals you know sometimes I can go very quickly

[0:51:05] sometimes it can be kind of drawn out but we're anticipating where to let this project this summer. And then finally phase two and phase three will be leading in 2019 and 2020. Eric, do you have any questions? This is yours. Well, I will have to tell you this. I am so pleased to work with this particular spot. There's not a week goes by that a citizen doesn't ask me. When are you going to fix Bell Street? So as soon as we can get there, and I know 12 months into this project, when are you going to finish that phase? But let's get started first. That's right, and I'll speak for Johnny Silva's Johnny fault for this for the last five or six years He was on council, so I know he's happy as well. Any other questions from council comments Russell, thank you very much I just wanted to know if the new signals if they're going to be traffic signals are they going to be led? Right, yes all the new signals will be led they'll also include pedestrian elements so that, you know, somebody needs to cross the street, you know, they can push that button on the side and then they can, you know, the traffic will recognize, or the signal will recognize that there's a pedestrian there and they'll let, you know, stop traffic accordingly. Okay, thank you. Everything sounds good to me. Will there be an increase in street lighting? No, this project does not include any type of streetscaping or street additional street lighting. This is considered approving a sublease of the following. Lake Nazworth residential Lotley 1601 Shady Point Circle Lake Nazworthy.

Cindy, I'll ask you to come forward first and kind of get this started for us, please ma'am. I'm Cindy Priest, real estate manager for the city. The matter before you today is a request by Lake Nasworthy tenant. The tenant is requesting that he be allowed to sublease Lake Nasworthy residential lot. The tenants are Edward and Monica Richmond. The council did approve a sub lease through March of 2017. That tenant is now requesting that the sub lease be extended till June 30th, 2021. I'd like to now introduce Mr. Richmond so he can discuss with council his request. Yes, ma'am, come forward, please, sir. Introduce yourself, we give you three, if you can't get through, then I'll ask the council to give you smoke. Good morning. My name is Ed Richmond. I am the owner of 1601 Shady Point Circle. It's interesting you keep calling me a tenant. I've never spent a night in that property. When I purchased this property in 2010, it actually had two ASU students in it as a rental. And when it conveyed to me, this property came to me as a rental property. And it was in a rental condition for the five years prior to that and I've maintained it ever since December 2010 as a rental property as long as I also have four other properties here in San Angelo. Back in November I received a letter from the city saying that I'm out of compliance with regards to subleasing my property. You all have been working on short-term rental stuff. I've been seeing it in the news. I'm sorry. That's a tough that's a tough battle you guys went through and it was really contentious. But there's a side effect with regards to that because what ended up happening

[0:55:09] as you went and started looking at the Lake Lease, which I've had now for almost seven years, never before had there ever been a problem. But there was now apparently I found out I'm out of compliance. At which point the day after I got this letter, I contacted the city and I said, I'm an ex-vable officer. I do things by the rules. How do I resolve this issue? According to the paperwork that you sent me, it says I am allowed to rent my property with permission from the city. What options do I have? The city came back with the answer, Mr. Richmond. The only way that you can rent your property from now on is you have to buy out your lake lease. I said, well, unfortunately, I don't have the financial well with all right now to do that. I started sharing with him my hardships. My wife lost her job last year for six months. We actually ended up having to pay cobra payments. We had to pay mortgage payments. a lot of the people that I actually read somewhere in the paper, I guess, today. There's an article about this whole thing. I read that people actually have the wherewithal to actually purchase the lots. I don't. So here I am. I have a Lake lease already. I actually have sub-least it. I had a year lease last year. The city asked me for how long was that lease good for? My one year lease that I had last year was supposed to extend in March of this year. My tenant bailed on me in December. So my property now is now vacant. My property manager's been trying to rent it. I've talked to the city and I've been told I can only rent my property until March of this year. Rental properties, this is a rental property, I don't live there. It has no value to me unless I can rent it. So the options that are in front of me right now, and I'm appealing to you in a very vulnerable position. Either I get permission to continue to rent my property, or I'm going to have to sell it. The reason why I'm here is I've actually worked with Mike and he said Ed There's something called and we he as we talked on the phone trying to work through this He goes Ed, you have a compelling story. I'm sort of caught up in with all the short-term lease stuff

[0:57:10] My time and give him another couple minutes Go ahead. So I'm stuck in the in a gray area Pretty much I have two options either I get permission from the city Which you are allowed to do to continue renting this property and I don't want to do it for perpetuity, my late least states that I actually have until 2020 with regards to this lease and that actually fell in line with regards to my dollar going to college. So our plan would initially was always to actually sort of hang on to that time frame and sell it at that time frame. Right now the market's down. So I guess I'm in a very vulnerable position. It's in your hands. You've already given me permission to keep printing my property. If I don't get permission to continue you're gonna be forcing me to sell this property in a down market, so I wrote my little notes here. I'm trying to appeal to you. So I'm standing here with myself, my wife, with very meager savings, and we have a tenant that wants to move into this property. On the 15th of this month, he's already given a security deposit, but in order for me to do it legally, I need permission from the city to be able to continue to rent this property. And it's not like this property has never been a rental property, it has always been a rental property. Any questions? Bill, this is yours, start off, please. So you've been out of compliance with you at least from day one. Unknowingly, yes, it's like you're driving down the road. Come on, come on. You read the lease. Sir, I bought it in a lease condition. No, as far as I'm concerned, you've been out of compliance with you at least from day one, and I'm not in favor of extending the lease. Any other comments from council? I think most of this council and the city staff knows my position. I don't think the city needs to be in the property management business to begin with. We need to get rid of these leased properties and get them back on the tax rolls so that

[0:59:11] we can continue to get property tax that will allow the rest of these citizens in Angelo some relief. So from my perspective, I can't support this either. Anyone else? Okay, I have to correct myself. We're not going to deny you to continue your lease, but you have to be in compliance with the lease. And you've been out of compliance, knowingly out of compliance. You read the lease and you sign the lease and it says that you're not allowed to sublet the property. And we, through the goodness of our hurts, let you continue that to the end of the march. And that's all. And make a comment, sir. And is that actually not true statements, sir? When I actually rented the property conveyed to me, it actually had two ASU students who actually stayed in that property for an additional two years while they were finishing school. That property was actually rented to me, or purchased with two students already in there. And as regards to the paperwork, all that happened at the time of the transfer of the title, the paper was actually transferred to me, and honestly, I knew no idea, and literally for 10 years, this property has been in a rented position. So the idea says, I'm allowed to, I am allowed to rent this property with permission from the city. When I found out that I was out of compliance, I specifically came back to the city with regards to asking permission. No, you're not allowed. You're not allowed. You signed the lease, you should have read the lease, and you should have come in compliance and not allowed those tenants to stay there because that's not in compliance with the lease. How were the people that were in the property prior to me purchasing it there? That's the reason why I'm saying is it's disingenuous to say that It wasn't allowed when I purchased it in the condition that had been in that condition for five years. Okay, we're not gonna talk about,

[1:01:12] we're not gonna talk about what happened before you leased the property. You leased the property, you signed a lease, which this allowed you to sublet the property. Well, currently I'm in compliance because you allowed me through March of this year. I am asking for permission to continue renting or otherwise the only thing that I can do is end up selling the property. And as a veteran, I'm here in a very vulnerable position asking for your assistance and able to do what I've been doing with the property ever since I've had it for the whole seven years. I think did you have a comment, sir? We've ran into the situation through the whole short-term rental effect. And if we make one exception, we have a couple others that will be presenting the same with their short-term rentals coming towards us. I agree with Harry that we don't, City of St. Angelo does not belong in the leasing of real estate business, and as soon as we can sell those lots to the citizen and get it on the tax roll, the better. better. But I have a contract with the city to actually rent the property. So it's only the only thing we're talking about is the use of the property. We're not talking about whether you're in the rental business or not. I already have a contract with the city with regards to the leak. The current subletting leak. The let's ask Cindy to come up and explain it. Cindy? Currently on the property is with Mr. Richmond and his wife. His request is that he be allowed to sublease the city owned lot and that's something that council has asked staff to pursue the subletting of these lots to let the tenants know that it's not in the lease that they be allowed to do that without council permission. So our lease is with Mr. and Mrs. Richmond and not any subtenant. So the law says, so the

[1:03:20] rules say that we can if you lease a lot you cannot sublet it you cannot sublet it without written permission from the city okay Harry Cindy before you run off just so the public knows what was the appraised value of that particular property I believe in a couple of years ago that appraisal came in at $23,000 and just for the record what's the lease on it the annual lease right now mr. Richmond and and his wife have a lease of $600 a year, that lease fee, yearly lease fee will not go up until July 1st of 2021. At that time, it will be based on the appraised value of the property or $700, whichever is greater. Lissie. I just wanted to say the same thing that Sennie just said that that's what we had agreed on, that the leases at the lake would not be subletted by anyone. So I think we need to stay with that. And sorry, sir, but I believe that we need to stand behind what we just asked Cindy to do, and that was to not have it written out to where the Leasers could sublet the apartments or the land or the residents. Right, Council did authorize the subletting through March of 2017, which would have fulfilled Mr. and Mrs. Richman's current commitment to a sub-tenant. I need a motion somewhere. First public first reading and public hearing for case VP1603 in ordinance approving an amendment to the vision plan component of the comprehensive plan changing certain lands from the neighborhood future land use category to the neighborhood center future land use category generally located along the north side of West Loop 306 frontage road between Brooke Hollow Lane and Southwest Boulevard and I assume that F will go along with this after we make this change. Yes that is correct. Brother James you had the floor. Yeah and in fact well let me first say I'm John James, Director of Planning and Development Services. I do have a presentation that will cover both ENF and and then you will have to vote on each separately at the end, but this kind of combines the issue since it's the same property. It is about a half acre property located on Loop 306. It is, has been vacant for a number of years and that sort of plays into part of our recommendation. It does have, off to the, I guess that's the West, is an office bank building, but then there are a couple

[1:07:28] of apartments back to the north, and that also plays into part of our recommendation. The future land use of the area is neighborhood, and what's being asked today is to change that designation to neighborhood center, which would allow a commercial, small commercial use on that property. This area was planned all to be part of the neighborhood. lot because it's fronting on the loop did not have the interest for you know anyone to build a single family home or an apartment there and that's part of the reason it's been vacant so long and so now the applicant is seeking to do some type of commercial development on the property which prompts a change to the future land use map. The zoning map it is currently office commercial so the zoning does actually allow some office uses on the property but the proposed plan development that we'll talk about next would continue to allow the office uses with the addition of some other items as well. This is the concept plan that the applicant has proposed. You can see office building and then a billboard. That's one of the primary reasons for this being a plan development. Our office commercial zoning district does not normally allow for a billboard on the property, but rather than rezone it to something like a heavier commercial or industrial zoning, we felt it was more appropriate to keep it with the office. Again, the office uses next door and with the apartments next to that, we thought those higher intensity commercial uses may not be as appropriate. So again, the plan development being proposed would continue the office uses that would be allowed but also allow for that additional billboard. As we look billboards throughout the area you can see in green here all of the existing billboards so this is a corridor that already has a number of billboards and again it's simply because of the particular zoning on this property that

[1:09:28] another billboard wouldn't be allowed so we think at least in this corridor it's appropriate for this plan development to go ahead and allow that additional billboard doesn't want to show the pictures this is again the pictures the area you can see the the bank building back here and then the apartments next to this site. We are recommending approval of the Future Land Use Map Amendment. It does seem to meet the vision goals it is. Commercial would be appropriate right up on Loop 306. If this was more in the middle of a neighborhood, I don't think our recommendation would be the same. But again, because it's on the freeway, we think it does meet all of these rationales for approval of a change. Similarly, with the zone change, we do think it is compatible with all of our plans particularly if you make the change to the future land use amendment and we don't see any problems. The one potential problem we saw with the billboard is this adjacency of the apartments and we worked with the applicant to ensure that the placement and lighting of the billboard would not create negative impacts on those neighbors. They're for example by shielding the lighting and orienting the Orientation of the billboard to face not directly at those those Apartments we did send out our notifications and did not receive any in favor or in opposition the What you're being asked first is to as I mentioned change the future land use from neighborhood to neighborhood center And then by a separate vote we would ask you to approve the change from the office commercial zoning to a plan development district staff does recommend approval of both as did the planning commission. We have to answer any questions. Also have the summary of the conditions and the plan development.

[1:11:28] I'm not going to read through those, but they're in your information and on the screen if you have any questions. And the applicant is satisfied with this as well? Yes, I believe so. I wish that we had something in our permit planning that used just a little bit of common sense so that these things could be dealt with instead of bringing them to council. I think the staff did a very good job of vetting this and there were a lot of questions that the Planning Commission answered. and answered. Item G, first reading in public hearing for case PD 1609, in order it's proving a request for a rezoning from the planned development PD 9703 zoning district to a new planned development PD zoning district to allow for all of the permitted uses in the general commercial CG zoning district generally located approximately 700 feet southwest of the intersection of sunset drive and West Loop 306 your own sir thank you this is a request for rezoning of a planned development this is the the area of Sherwood in Loop 306 this is the shopping center with the target and used to be the office max bed bath and beyond and all of that. The only the portion in red you see is affected by this rezoning but it is part of that whole shopping center. As I mentioned this there is an existing plan development that governs this area but because of the new proposed development on the site it requires an amendment to that plan development in this case we're actually creating a new one because it's not affecting the entirety of the original plant development. The future land use does show this area is commercial and the zoning map as I mentioned is that plant development from 1997, pictures of the area. So here's what's being proposed to new buildings within what is now the parking lot. We have looked at this area even with those two new buildings. They will have more than enough

[1:15:33] parking on the site so that's not a problem and there is a there is a shared parking agreement with the rest of that whole shopping center as well that will be maintained to ensure parking for the entire area. It is compatible with our plans as well as the zoning ordinance I mentioned the parking it is compatible with the entire area as a general commercial area no anticipated effects did send out our notices to the surrounding area did not receive any responses in in favor or in opposition. That is recommending approval of the plan development. We initially recommended five conditions of approval. The Planning Commission also recommended approval, but with only four of those conditions. Here are the conditions. As you see, we had recommended that an urban design review be required. Right now, urban design review is required if new buildings exceed 20,000 square feet. We had recommended that that be required, regardless of the size of the buildings, given the entirety of the shopping center, but the planning commission recommended striking that particular condition. I'd be happy to answer any questions. Harry? Well, I was in the planning commission meeting on this one also. I think it's very well done. And the planning commission asked appropriate questions the staff really did a very good job on this. I recommend for approval is a move to approve as presented. Second. I got a second from Bill. Zoning District to a general commercial CG zoning district, generally located approximately 550 feet northeast of the intersection of Knickerbocker Road and University Avenue, your own sir. This is a request for rezoning. It's a little over an acre on Knickerbocker. It's a vacant lot. Rotten next door is another restaurant. The potential use for this property also a restaurant and so you can see the area of the future land use of this whole area is commercial. However, the existing zoning for all of this area you can see is lot manufacturing. Apparently, at some point in the past, it was identified as an area that might develop as manufacturing and industrial type uses. But as we've seen the development happen in this knickerbocker corridor, it's largely commercial, but that holdover lot manufacturing zoning is still on the property. We've seen a couple of other of these after requests zoning from the industrial. One thing I'll mention is that we are looking at maybe coming back to you and just rezoning much of that corridor so that we so that every property owner who wants to come in and develop doesn't have to go through the same process. We can kind of clean up that zoning again since the whole corridor is really becoming a commercial an office medical corridor, very little manufacturing in that area. See, the subject property is currently vacant, although there is both apartment and restaurant development around it. Reasons for approval, the zoning ordinance does require that we consider all of these factors. We believe it is compatible with the plans. It's consistent with the zoning ordinance and compatible with the surrounding areas. I mentioned, again, those change conditions are that the Manufacturing has never materialized in this corridor and commercial does make more sense We did send out our notifications surrounding this property. We received two in favor and none in opposition

The county has presented us a petition for disannexation of this area, largely for the purpose of pursuing a state grant for the sewer line, for the jail project. To be eligible for that grant, the property has to be outside of any city limits. And so they are asking to disannex. Today is not the actual disannexation. You're not voting on pulling this area out of the city limits. There's a state process that's outlined for either annexation or disannexation. This is basically accepting the petition and starting the ball rolling on that process. Part of the reason for that is if you were to look at this and say there's no reason to do this, we're not even going to consider it. It would save everyone the time and hassle of going through that whole process. But again, this, so this is the petition from the county to disannex the property. You can see the survey of the property there. It is about 184 acres. Staff does recommend accepting this petition and starting the process of considering that, including all the public hearings necessary.

This would just be the next phase of that particular subdivision. And so the developer is asking to come into the city limits in order to do that next phase within the city and get all city services. That's the survey of the property, about 17 acres. Staff is recommending acceptance, and this is similar to the first one, or the disannexation. The agreement is actually with the foundation the Fort Concho Foundation. They're going to be responsible for securing the funds. We're essentially under this agreement granting them access to the facility and allowing them to do this reconstruction and then they will dedicate any improvements to us at the end of it. They're also making sure that we are covered in insurance

And you put it, it's on skids. You put it in the back of your house. And it's usually for not a long period of time. But it is just an answer to some of this expensive nursing home things. And it's something that people, it's something that everyone in this city could benefit from. Because my daddy was in one for two years. And that $7,000 a month is a little hard to take.
