I think I'll pull out and do a little preaching It's good to see everyone here We're very glad that you hear this morning and to take time to come and be a part of your city government This is grassroots democracy, and we thank you very much for being here with us today. It is 834 Brian We will begin our meeting this morning with prayer. I have asked Brother Ron Guzman the pastor at the West Angelo church of Christ to lead this in prayer. I would ask you to stand as you are right. Father we thank you so much for all the blessings that you give us. We know that you through your Apostle has said that we have been given this really everything by you and we appreciate that. We think life and breath and all things. We ask now that you might help with the wisdom and help us Father just not be dismissive of your divine wisdom as we approach each other as we approach issues that have to do with our city. Help us to learn from one another, be gracious to one another especially. We thank you for this new year Father. We ask for your blessings on it. We have some city employees that I would like to recognize this morning. I'm awful proud of you guys. I'm awful proud of you guys. It's recognition of our parks and plowies for winning the sports complex of the year award For our Texas Bank Sports Complex, I don't bail straight, and I think this is a second time that you guys have won this award. All these say the same thing. I don't have to read every one of them, okay. The Texas Bank Sports Complex, and you guys come up. Come on up while I'm reading this. The Texas Bank Sports Complex, as once again, been named the Best Sports Complex in Texas, thanks to the efforts of the city of the San Angelo Park Workers. The Texas Turf Grass Association last month, name the site, it's Sports Complex of the Year for 2016, and this is the second time in five years that Texas Bank Sports Complex has earned the honor. It also won it in 2011. City parks to employees who maintained the 80-acre site and earned the award of Marcus Hinojosa, Jason Campbell, Daniel Aguilar, Gary Polk, Kevin Salaya, Daniel Bajal, Michael Blaylock, Richard Scott, Tony Harris, Mike Hitchcock, and Roger Hevlak. The Sports Bank complex opened in 2009 and the site has 55 acres of irrigated turf plus 15 ball fields. Ten of those fields are used for softball, baseball, football, and soccer.

[0:04:01] The site also has two regulation baseball fields, two little league fields, and one T-ball field. It also boasts two restroom concession facilities with the third and the works. Four sand volleyball courts are parked with a playground, picnic tables, and four parking lots. Texas Bank Complex has become a vital recreation and tourism tourism cog. It is used year round and host some 45 events and tournaments each year, including the biggest Easter egg hunt in this whole state of Texas. The complex holds four sessions of adult softball with 120 teams, 90 flag football teams, 30 little league squads, high school softball and baseball games in a girl's ass fits softball league. Therefore, I, Dwayne Morrison, the mayor of the city of San Angelo on behalf of the city council, do hereby recognize and applaud the city of San Angelo Parks employees for their achievements and positive determination to make a difference in our community. We don't realize how great we have it here in the city of San Angelo, I truly believe it's the sweetest spot in all of God's vast creation, and I'm proud of everything that we have all done to make this possible. School board recognition month, bring them forward. Come on in, Bill. How are you, man? We've got all of you, don't we? Good morning. We have full board here, don't we? Max, Max Parker's missing. The mission of public schools is to meet the diverse educational needs of all children and to empower them to become incompetent, productive contributors to a democratic society and to an ever-ranging world. Local board school board members are committed to children and believe that all children can be successful lifelong learners and that the best education is tailored to the individual needs of each child. Local school board members work closely with parents, educational professionals and other community members to create the educational vision that we want for our students. Local school board members are responsible for ensuring the structure that provides a solid foundation for our school system and local school board members of strong advocates for public education or responsible for communicating the needs of the school district to the public and to the public's expectations of the district. West Texas Rehabites Rehabilitation Center, which was founded in Abilene, Texas in 1953 to provide outpatient physical rehabilitation treatment services to all who turn to it for help. Every day, approximately 250 San Angelo area children and adults receive West Texas Rehab's top quality care and overcoming the disabling effects of illness, injury, or birth trauma. The Rehab Center not only provides nationally respected rehabilitation programs, but also contributes to St. Angelo's economy by its employment of 90 highly skilled and well trained personnel and further through its local $7 billion annual operating budget. This unique organization will have its 47th annual telephone on January the 21st of 217, a fundraising event which is critical to its ability to divide care to every patient regardless of their financial status. Now therefore I do many more in the Mayor of the City of St. Angelo Texas on behalf of the City Council do hereby proclaim the week of January 1621 2017 as West Texas Rehabilitation Center Appreciation Days in San Angelo and recognition of the Center's 40-year commitment to meeting the outpatient rehabilitation needs of this community. Mobius syndrome is a non-progressive cranial facial neurologic, neurological disorder that manifests itself primarily in facial paralysis. Individuals, Mobius syndrome cannot smile or frown and do not have lateral eye movements. Many individuals, Mobius syndrome, also have skeletal involvement with limb abnormalities. People with Mobius syndrome can have respiratory problems, speech and swallowing disorders, visual impairments, sensory, into the integration, dysfunction, sleep disorders, weak upper body strength and autism spectrum disorders. The causes of Mobius syndrome are unknown, although the condition probably results from combination of environmental and genetic factors. Researchers estimate that the condition affects 220 per 1 million people. This Syndrome Awareness Day is an annual event celebrated globally each year on January 24. The birthday of Professor Paul Julius Mobius, the doctor who first diagnosed the condition in 1888. The goal of Mobius Syndrome Awareness Day is to raise awareness about the rare condition and educate the world and each year. Participants are encouraged to wear purple and to raise awareness. Now therefore, I, Duane Morrison, the mayor on behalf of the City Council of the City of San Angelo, proclaimed January the 24th, 2017 as Mobius Syndrome Awareness Day.

I was asked the other day, why, 34 years later, with my, with Modi, it's why, now, raised awareness when I've had, I lived with it all my life, and I told my friend that it's not really common. And I was a young girl who grew up more and more, and I never had, I never met anybody like me, ever until the show, last year, 2016. I went to a Modi syndrome conference, where I met people from Nigeria to Africa, to the UK, to Colorado, Canada, all around the world with Modi and Xinjiang. And I came back with this desire to raise awareness, because not many people know what it is. But I am one of the fortunate ones in 1994. I had a smile surgery, 14 years of my life, I could insta-mile in 1994. I went to Toronto, Ontario, Canada. Where Dr. Ronald Zuckle performed my smile surgery, I called it my miracle surgery, where he took the muscles out of my inner thigh and placed them into my face and helped me smile. Also, I just want to say my CEO, Shannon, and I see, you know, from Shannon out here and can they come up please? And also the Chief of Police is supposed to be here.

[0:25:24] Good morning. Council. How are y'all? Good. For the record, Roland Pinya, Director of Economic Development, I'm here to help answer any questions with this regard. I believe our legal counsel was going to be available to provide her input, and I'd be glad to assist in whatever support I can provide. That's Charlotte's question, Charlotte. This question was one that I put on for the gentleman in the public that asked and just an explanation of the settlement and where the proceeds from the settlement will be funded back to. We looked at the percentage that each of the parties, the city and coast of DC, put into the original agreements with Hirschfeld, and that was the percentage on which we divided the proceeds, which was $1.4 million after we deducted the attorney's fees. Attorneys fees in this case were $142,745, that would leave 21% of the proceeds going to the city, which is $264,000 and $263,000, and the rest, the $993,000, $231 going to Costa DC. Any further questions? I don't have any further questions. Does the, Steve, do you have any more public questions that this was your item you requested to be pulled? Yes, Steve Hampton. I was under, you said the attorney's fees were only $104.00. I wouldn't work, $142,000.00. $40,000.00, okay, I thought that was hearing crooked on that. Oh, maybe I said it wrong without the Senator, $40,000. Well, and the original fee that was dispensed was how much? 1.4 million. So we're getting the complete amount that was initially given. [0:27:24] 1.4 million is what was agreed in the settlement discussions. That was approved by Council last April. Approximately. So we're getting the full amount back. Okay, that's what I did not know. Can you say the full amount? Are you speaking of the full amount of money that we invested into the project? Correct. The contract amounts. One eight. Let me help clarify. Our damage calculations initially with interest was around $2.7 million approximately. But as we began our settlement discussions, this is what the Council the Council and Co-CDC Board and Marta for agreed to a $1.4 million settlement in addition to other provisions in the contract that asked for additional jobs and a million dollar capital investment in a real spur to help the plan continue to grow. Mayor, if I could, additionally, we did receive some benefit while not all of the target objectives were achieved as a result of the contract, the city and the community did receive some benefit. So to I think Council considered that as a developed, a compromise position and so full recovery of everything invested does not contemplate the benefits that we did receive. Even though the total amounts were not achieved, we did receive some benefits. So a compromise position, I think, was based on the idea that there was some benefit received. This was a settlement that we reached with Martyr Perk, and had we not reached a compromise,

Item number eight is to consider a resolution abandoning, vacating, and releasing a 24th wide access in utility easement of totaling 3,966 square feet located in the she-hand. Subdivision section one-aid, generally located approximately 570 feet southwest of the intersection of Sherwood Way and Clare Drive on 0.091 acres. I'm going to ask you a little bit of detail about why we were doing this. This is an easement across an existing property. It's athletes' world, business there on Sherwood Way. It's an access easement that allows access to the back of the property as long as well as utility easements. We ran through our process where the surrounding property owners were notified as well as all utilities in the city. property owners were notified as well as all utilities in the city and there was no reason to maintain that particular easement and the purpose of the abandonment is to allow them to expand their building on top of what is currently an easement so they cannot expand unless the easement is removed. And there were no objections from the surrounding residents there that it backs up. Well immediately behind it is actually a parking lot for the car dealership which is part of what the access season was providing access to but because that lot is now part of the the the car lot there's really no need for that and commercial growth moved to prove is presented motion to approve who say it length any further questions from council public comments all in favor please say aye aye aye aye aye a number

What's basically both J and K are for one of them's for an awning and one's for a canopy without door seating so the first one Jay is the canopy without door seating and because that's extending into the city's right-of-way it requires approval from you for

[0:33:33] use of that right-of-way but there are conditions in place that ensure that for example the sidewalk will will be maintained that people can get through those sorts of things. As long as they have a they're enclosed area like what is it? If it was it is down there. It might be similar. Yeah similar. Move to to approve J and K both as presented. Second reading of an ordinance amending chapter 12, Exhibit A's on ordinance for bed and breakfast establishments and short-term rentals. Come on up, John, you're going to be here a while on this. I don't believe this ordinance gives enough protection to the adjacent property owners. It doesn't give enough owners on the owner to provide financial compensation for if their property is damaged. Also, the Fort Court of Appeals has ruled that these short-term rentals are transient, and they're not classified as residential. We've dealt with this for about six hours over the last several months. We have approved this. Well, first we disproved it, and then we brought it back and approved that this is a second reading. We've heard the comments, we've taken hours and hours of testimony, we've heard from both sides. take public comment if you got anything new, but I don't want to hear the same old things over again. There's no reason in going over these again. If anybody's got anything new, we all know what this is about. We know why we're here. So if there's anything new that needs to be said, come say it, at this time, please.

[0:35:40] You, Hampton, Mayor Council, I feel that I was originally kind of on the line with this situation but I have in the last meeting that I heard I don't know something touching my heart or something I felt towards the property right side and feel that like Bill said that there's not enough compensation or consideration given to them I think and I know it's not on your full control but But that those who are in the situation of having a short-term rental in their neighborhood are real close, within the 500 feet, I believe it was the area, those people lack control of their property and some kind of compensation needs to be given to them or consideration. not by the city, but influence could be applied. I know you have a bully pulpit and it could be rendered. Maybe those people who are within that area should get an appraisal reduction in the neighborhood of like $50,000 to so that they can deal or continue to cope with the situation. It could be to manage the further you go away from the center, but you've let something illegal and I've come to embrace in and you're going to have, this is going to come back on you and people are going to lose evaluation and it's going to come back

[0:37:45] And they have grounds, I believe, for lawsuit against, in this situation. So I believe some kind of consideration, if you can't go, if you feel like you have to go this way, then fine. I believe that it's unwise and will open us to legal action in the future. And that's all I have to say, thank you. I haven't been able to attend the other. With the name for Terry. My name is Terry Mobley, Mayor and City Council. I have not been able to attend the previous meeting. So if I am saying something that has already been said, if you will, signal me and I'll leave. I would like to give a perspective of I'm one of the evil vermin that actually uses these type of facilities. I've been doing this since 2003. I'm the type of person that, uh, when I enter the neighborhood, uh, women folk and children hide behind locked doors, apparently, uh, I would offer that I have not in any instant scene properties devalued that were used in this place. I stayed in a two bedroom house, didn't have air conditioning, uh, it was valued at $1.2 million dollars. Now it happened to be on the beach in Hawaii. Perhaps it was valued at four million before I went and spent a couple of weeks there. I'm not sure. But my experience is the people that set these things up, they run them professionally, they protect their neighborhoods because if they don't, they don't stay in business. Are there exceptions to the

[0:39:48] rule yes or exceptions to the rule and I will not disagree with that. There's also somebody that's going to win the lottery but most of us aren't. I just think that the council needs to look very hard at this. It's an opportunity a lot of people look at these as investments away to paper homes that they use and watch top that. All right. I'm Ted Logan, the current president of the Lake Nesworthy Homeowner Association. I just want to make several points. Some probably have been entered before, but I think they need to be reiterated. This issue started two years ago, as y'all well know, in the city was not enforcing the orness that they had in place. And instead of determining that all the illegal STRs could continue to be terminated, they continued to operate them until the Arnus was changed. I mean what good is an Arnus is the city's not going to enforce it and we had one in place and it wasn't enforced. To me this was the opposite of what should have been done. In November 7th of 2016 the city came out with a letter addressed to all residents and leaseholders at the lake prohibiting STRs. The city said they will not allow STRs on their lease properties, but you as a homeowner we have to allow them or allow them next door to operate

[0:41:50] until this ordinance is adopted. And this isn't going on for two years, this has been a nuisance. Why does a homeowner have to put up with it if the city says they're not going to allow it? When the sale of these lots started happening in the early two thousands. The city designated all these as RS-1 or residential. Not like commercial, not office commercial or something else. They intended to have no commercial development like SDRs to disrupt the neighborhood environment. So now the council is going against a city's previous decision to disrupt the neighborhoods at the lake. The change of this ordinance is completely unenforceable. The city would have to make at least one or two calls a month on each SDR to determine if large tents, RVs, parking was being an issue and I don't think this is going to happen. This would take at least one or two more code enforcement officers, I don't believe that's going to happen. This, again, puts the burden of enforcement on the neighborhood. These neighbors have to worry about what's next to them, a new neighbor every weekend. Law enforcement is taxed enough, and they'll come out generally when called, but probably once. And after that, if a crime hasn't been committed, they're probably not coming back. Austin and other cities have had STRs being phased out. What's the reason for this? There's been a problem. I mean, Austin's a big city. They've been doing it for one year years plus. Why do we want to start something that in ten years it's unenforceable or we have to eliminate the problem to handle it? Let's

I know this is a citywide ordinance but But where do the people want to rent? They want to rent at the lake. So this is a lake problem primarily. And the homeowner is going to have to deal with the problem. Most of these homeowners at the lake have been made a large investment in their property. As your real estate people will tell you, the average price of a lot of sales is $110,000 now. Well, does a homeowner have to worry about having a devaluation possibly other property in the next 10 years because of the problems that are existing in the neighborhood? Is this really fair to that homeowner? Is Bill was saying, I mean, I think we've got to realize the burden upon the adjacent homeowners when these go in. I'd like to, I appreciate y'all looking hard and long at this. I just don't think the city can afford to make an ordinance they can't enforce or live with Thank you, Ted Anyone else care to approach and because you do represent the Lake Association I did allow you a little little tolerance on that Anyone else care to speak I need a motion to either approve or deny and we need to take another comment Yes, sir. I have a comment also. Okay. Okay. As far as the ordinance enforcement, the local government act and their charter required

[0:45:59] us to enforce that, the present ordinance until a new one is put in place, that's the law. Okay. And as far as this ordinance is allowing grandfathering, and I mean, if it walks like a duck, quacks like a duck, it's grandfathering and we cannot grandfather in illegal activities. Thank you. I do have a comment and the reason I do, Mr. Mayor, is when you said it was approved it wasn't a unanimous vote and I would like to just address that. As I was preparing for today's council meeting I sat down at my computer and did not have a lot of luck with the city's website in in finding what I wanted to find, which was to look at what we were changing from and what was to on last council agenda. At that point, I just decided to pull my hard copy file because I'm not a good computer literate person and it was taking entirely too long. And so I understand the frustrations of the people out there that call that wanted some sort of explanation as to exactly what we were changing. I wanna make it clear that I voted no at last council meeting on this agenda item. And because of the calls that I've gotten, I feel it necessary to explain my no vote. My understanding of the item that was presented, we were voting to accept the amendments to the existing ordinance. I did not feel that the changes provided by the committee met with the problems that we are experiencing and will continue to experience should it pass. In other words, I felt it was foolish of staff's time to continue to try and write a ship after the bell is rung. You just can't unring a bell, especially on a sinking ship.

[0:48:00] There is a lot of confusion out there of exactly what we're voting on, and I'm gonna give you some of those examples of the calls, emails, and texts that I had been receiving and I assure you There has been a tremendous amount, as Harry has stated, that he has been receiving. One comment. I have heard there is a vote on to allow or not allow vacation rentals. Please vote no. Another comment, I am all four vacation rentals. Another comment, I am four lake rentals. Another comment, please vote yes to the lake, nazworthy rentals. Please vote no to vacation rentals at the lake. Vote no to all rentals in St. Angelo. I enjoy visiting St. Angelo in renting houses. Vote yes. Please vote against vacation rentals because of absentee owners. Vote no to STRs. And what exactly is an STR? But I've heard we don't want them. It would be living next to a hotel. I mean, these long conversations, once you started talking to people or emails, and if they were, email was addressed to me only. I responded, if you did not get a response from me, it's because you sent a mass email, and it's considered a walking quorum, and not one of us up here can respond to it. So it's not that we don't care, is you can only talk to just one of us. Now, you can address it to one and send the same email, change the name on it, there's nothing wrong with that, but I wanted to make that clear. Also I have heard that my vote was one of fear for future election results. I've also been told that I've flipped because I was going to vote yes and then I voted no. I want people to understand in my time on this council I have never compromised my beliefs for votes

[0:50:01] And I don't know how others know what I'm going to do before I do it, because a lot of times I don't make my decision until I get up here and I hear from you out there and I hear from the other council members because there's a lot to be learned from my fellow council members. It's very enlightening to listen to different people and their fields of expertise and what they can bring to the table. But last council meeting, I felt that we, the city, had not done enough due diligence on how to correct something that was and has been allowed since before 2003 without any complaints. This is a practice which most have been participating in according to their or a city representatives understanding of the ordinance and paying taxes on. I felt that we did not address existing properties sufficiently. We did not address a written review by the Vialta Group master plan to our outdated zoning issues at Lake Nazworthy and its rapid growth. The city needs the future development such as utilities and roads and what can be accommodated now or in the very near future. I felt like we totally ignored violence as recommendation to create recreational zones by our city, which can be done under an overlay project. It just takes a lot of work. I do not feel we can limit one property to participate and the property next door can't, in my opinion, that would fall under discriminatory laws if we did. I also questioned just how many streets at Lake Nazworthy are 30 feet wide or more. I also question the number of 20 being allowed at a gathering. All of this said, I do not feel we covered or researched how to protect existing property owner rights

[0:52:03] to a quiet and peaceful enjoyment of living. Each property owner is entitled to the same owner property rights and yes, even those who are right next door to one another. Did we consider STRs in a recreational area to be different than STRs in neighborhoods that do not have recreational value. I feel we must create zones that cover recreational living such as housing quarters, distance to recreational use and the nearest permanent housing situation. These are some of the reasons I voted no at last council meeting. I believe we should thoroughly research this nationwide change in a way that we view recreational facilities and zoning changes or not. The state of Texas views SDRs as residential. And until that definition is changed, it is what it is. I am of the opinion that we should work on our ordinances on this revision in depth before we piecemeal or band-aid the ordinance. I truly believe our citizens' property rights deserve every support to be heard. We're better than Austin or San Antonio or Dallas in our revisions. Now that we have heard from a citizen committee, this council could agree today to appoint a team of professionals in the field, such as an attorney, planning, property, appraiser, real estate banker, real estate broker, board member, zoning, and an ACM, to review and restructure this need and bring it back to council for review. that's a possibility. But if that possibility isn't considered, I will continue to vote no, as I did before, not that I am against STRs. But I agree with what some of you have said about the revisions are not stringent enough

[0:54:05] to protect existing homeowners, and their right to quiet and peaceful enjoyment in living. That is my position on it. Yeah, I like to point out that as I mentioned earlier that the Fort Court of Appeals in San Antonio has ruled that short-term rentals are transient and they're classified as commercial just same as a motel or hotel, okay? And I also like to point out that the lake now is where the plan has designated here at Lake as recreational areas. Thank you. Lane, do you have any comments? I'd also like to clarify my previous vote of no against this and that is because of the imminent threat of a referendum. They have the signatures. They can put it towards whatever we've to do and pass today can be taken back and costing our city in a special election. That is what I have been trying to prevent by the process that we have been going through by changing our ordinances with encouragement to put it on a May ballot or have it form a initiating committee by the proponents of this to where it would not cost $30,000 in a special election. Thank you. Now I'm still, I've heard everything that we need to hear. We've heard it over and over again. The staff has worked a lot on both sides. So to me, I feel like we should be ready to go ahead and make a decision today. Eric, you things, and I'll follow up a little bit about what Charlotte said. And for those of you that are in the audience on both sides of this issue, you know that I took public, I put comments all weekend from Thursday night through about six o'clock this morning.

[0:56:05] I had more than 300 people contact me, email, telephone, text, And I can guarantee you I heard both sides, sometimes I heard an extended version of everything, of why they're right, why they're wrong, sometimes I only heard vote for, vote against. The bottom line is, is I've spent as many hours or more than each of these council people up here have. So am I truly educated on this? Probably a lot more than I was a year ago. Do I know everything? I'm not sure that I do. Is this ordinance perfect? As Charlotte said, maybe not, but are all of our ordinances perfect. We have changed ordinances because they are not directly in line. So if this ordinance gets passed and there are things in it that do not work, in six months or a year, we can come back and fix those particular items. I also wanna make sure that everybody understands about grandfathering. There is no grandfathering out there. The eight properties that are out there right now that have been designated that are paying city and state hotel occupancy tax will have up to a year to comply with these roles. Everybody else has to do it immediately if this ordinance was passed. The bottom line is, got the ordinance, you've got the 30 foot streets, you've got the 500 foot between STRs. I think this ordinance, as it's designated right now, is a good ordinance. I also would like to say that Mr. Tad Logan is here, and I don't know whether he's speaking for himself or the Lake Nazareth, the Homeowners Association, but in the email he sent me or the text, whatever it was, Tad, that you sent me or the weekend,

[0:58:05] you signed that as president of the Lake That's where the Home Orders Association my understanding is you are acting president. If that's correct I don't know that you've been elected, but the bottom line is I didn't know whether or not you were speaking for yourself or for for the whole whole association I'd like to have John James come back up John and just talk a little bit Briefly about those particular points on the ordinance because I think there are people in this audience and people that had, that contacted me over the weekend, that really, really have no idea what this ordinance is. All our doing is flying by emotion. Which particular points? Well, really we would have probably talked about the word that's being used about grandfathering. There is no grandfathering, you know. People think that just because people, because there have been STRs being operated, that they're automatically going to be carte blanche on this. That's not true. That's correct. In fact, the only sense in which there's any thing that might be close to grandfathering is that those that are existing, the eight you mentioned that are paying both city and state sales tax, they have some extra time to come into compliance to get the license, get the conditional use permit, but there's nothing in the ordinance that says that they don't have to do any of that. They're still going to have to get the license the conditional use permit from the planning commission which could be denied and they have to comply with all of the regulations within the ordinance with the exception of the 500-foot separation and the 30-foot street. But like you said that is not grandfathering they will still have to go through all the steps everyone else does they just have a little more time to do that. Marty? I'll just make a motion. We we we approve the the ordinance. We'll have second.

I believe you know I checked I checked on something last last evening about illegal activities and the IRS will collect taxes from illegal activities. I mean, they taxed our component. But I don't know whether the state is aware that they're collecting sales tax from illegal activities and I believe it's the federal law which prohibits making a profit from federal from illegal activities. Okay I'd like to make my comments now and Ted I'm gonna start with you and I appreciate very much the fact that the late NAS worthy people have paid a lot of money for their property and they care for their homes and they've worked on their homes but I'm gonna tell you that I live out in Donkey Flats out in Lake View and you know I'm kind of proud of my home too and I paid quite a lot for my home and I'm pretty proud of my home and I'm gonna tell you there's a hundred thousand citizens in this city that paid a lot for their home and they're proud of their home and they've worked hard for their home. So I don't feel that just because you live at the lake, you are unique in this situation nor anybody else at the lake. So I, and it's my time. I took offense to that. I took offense to the way you stated that because people all over this town appreciate their property. They pay for their property and they're proud of their property. And as far as Lane, I would like to tell you that the charter that was written in 1915, gave every citizen that lives in San Angelo or will ever live in San Angelo the right of a referendum. That is one of the rights and the freedoms that we enjoy as citizens of the city. And we can't run from making the decision because we don't want to face the possibility of a referendum. That is their legal right. And if they want to get the signatures and bring this forward and spend the time and the money to promote it and take a vote on it, that is the

[1:02:16] right of the citizens, and it is our responsibility as counsel to allow this to happen. And I'm not going to run from any ordinance because I'm afraid that someone down the road might take advantage of illegal right that they have by charter. So to me, that is not a viable argument. This ordinance that John James has put together is a good ordinance. It is able to set restrictions. There is a two year, is it two year or did we go to one year on this James as far as the approval? year every year this has to be redone. If there's a problem with our police department, we've got a chief back there that is doing everything he can and he is protecting the laws and the citizens of this city. Whether they live in Lake View or Bellaire or whether you live at the lake and if you got a problem with the neighbor, whether it be a neighbor that's lived there for a hundred years or whether it's a neighbor with a 30-day lease or a 31-day lease which is allowed, you call the police department and they will take care of it. This is a a good ordinance, John. It gives us some rights. It gives the people that own STR's right, and it gives you rights as those that live next to it. And I think it's time to pass this and get this over with. I'll take any further comments. If you've got any public comments, I'll take a final. Mayor, one clarification. It is a one-year initially, and then after it's been approved, then the second time it goes to two-year. I'd like if John James could read that about grandfathering, because the way I I read it is that the grandfathering went for what was in that section which talked about the 30 feet width of the street and 500 feet away from each other. It didn't talk about they had a year to come in and if he could maybe read that or put it up so everybody could see that just to verify that. Yeah, and I guess the confusion there is that there are two different sections. One is where

[1:04:16] it talks about an STR cannot be located on a street 30 feet or less or less than 30 feet in width or within 500 feet of another short-term rental. That is exempted for those properties that are currently paying both city and state hotel tax. That's a pure exemption. The other element is those that require are required to or they're all required to get a conditional use from the Planning Commission those existing paying state and city hotel taxes have up to a year to apply for that conditional use. Those are the two different elements of the ordinance that might be termed some sort of grandfathering. That answers your question. Like each saying it doesn't give them they're not automatically given that it gives them the opportunity to apply the planning commission still would have to approve them as any other. But they would be allowed to continue for up to a year without applying for the conditional use but they only have the one year to apply for that. That applies to anyone who meets those criteria currently. They have a year to apply to the Planning Commission. As long as they're already paying city and state hotel taxes, which according to our records is only, we could only find eight of them that meet those criteria. Thank you, John. Clarified. So I just need to make sure. So if one is currently on a street that is under 30 feet with do they get to if they come in a year is that are they still allowed to be there even though it's under 30 feet as long as they're paying both state and local sales tax so they are allowed there's no they are allowed but they still have to get the license and conditional use approval and the planning commission could choose to deny that permit in those instances job John of those eight properties there are only two weeks existing properties that lie less than 30, 30 feet wide seat streets.

[1:06:21] Is that correct? That's correct. And we did not find any that were within 500 feet of another short-term rental. So that exemption basically is meaningless unless others that we're not aware of come forward. And to confirm with that, we, you know, this was brought up during our meeting the other day. And that's what we found based on the GIS maps. If the citizen knows of a different scenario, then we may have to go out and physically measure the street to make sure that but those are the two we could confirm from the GIS mapping system. Andrew Scottie, just want to touch base and I'll be brief. Charlotte, I thought that you came up with a very great idea and the investigation that I've been involved with for over a year and a half. There has been many planning commissions that have done exactly what you said. They they have set aside a subcommittee of professionals to study this issue first before diving off the deep end. I think that was a very wise idea. Now, in speaking something to Councilman Richardson, he spoke about the fourth Court of Appeals has ruled that STRs are a commercial property. Now, by the same token, the third Court of Appeals Israel that is a residence. The legal stuff that I have read says this is going to the Texas Supreme Court and they are going to make a determination. If they do make the determination that an STR is a commercial property, we will be in direct conflict with Section 104 purpose within our San Angelo code of ordinances, in other words, they will no longer be compatible from a legal point of view, and then this whole ordinance will have to fail and be repealed without a referendum.

[1:08:23] So it's something that you folks should probably take a look at, I'm sure that Lisa's probably already dwelt into it. I've pointed it out a couple of times before. I thank you for your time. This has been a long road, and unfortunately, the road, I can't see the end of it yet, we're still going to end up having to go out and do a referendum, whether or not. I know for a fact the timeline prohibits getting it done by May. We've looked at it every way we can. There's just not enough time. So I don't know if it's going to happen somewhere in the middle, if it's going to happen somewhere in November, others will have to decide that that are a lot smarter than me on those legal issues. But I do appreciate it and this has been a tough one because the property values that are most excited to me are the people who were their first living by the rules. Thank you very much. I'd like to point out one more thing. This ordinance does not comply with the home based business ordinance. I have further comment on this. I have further comment from the council on this. [1:10:26] 44 we got about 15 minutes before we take a break or does anybody want to take a break before we go into regular go let's do the presentation the regular gender presentation to the biennal report from downtown San Angelo ink devilaschus come to the front please sir thank you mayor I'm gonna make this quick I'm not gonna spend a lot of time on the I think that's ours that's not our that's our presentation either way I'll just go ahead and start off by letting you know that 2016 was a very good year for downtown San Angelo. We had over $68 million in property sales, renovations and new construction during 2016. Major projects that lend to that were the Shannon Medical Center, the first financial bank, the Roosevelt Lost, the block of nine buildings on North Chappern that were sold that are being converted into new businesses. And if you haven't seen the old Harry Food Store, you should take a good look at it. It is a beautiful building. They did a great job. One of the things that we're also very proud of is that fact that tears provided about $250,000 in funding during the 2016 before improvements in downtown. We had 16 new businesses open, which created about 114 new jobs in downtown. And we only lost five businesses either by relocation or they closed. And according to the text dot MPO city, we have about 27,000 vehicles that come into the downtown district on a daily basis. I'm going to say this is a joke. It happens usually at night. So we're real proud of the fact that we're creating an atmosphere that people are willing to come into downtown and participate and support

[1:12:29] our local businesses. Our still, our number one goal is to create downtown living. We've been working on that for the last five years and to help fill all the vacant and underutilized buildings, we continue to work towards that. This week, Thursday and Friday, the Wichita Falls Development Organization is coming into San Angelo. I've been in contact with them for about a year. They've been calling and saying, hey, what are you doing about this? What are you doing about that? So, I see that as a compliment to the program that we have established here. And so, they'll be here for two days, visiting and learning more about what we've done to revitalize our downtown effort. You know, the success that we've had, we've got a great economic development team which includes the Tears Board, which I mentioned, the Chamber of Commerce, the Development Corporation, Angela State Howard College, Workforce Solution. Those are just a few of the organizations that we work with in terms of creating and developing our downtown. I really want to thank Councilman Harry Thomas, he's been very attentive to addressing all of our needs as we move forward and so I wanted to say that and Mayor and Marty understand that this probably be the last time that you'll have to hear me taught in your official capacity so I really appreciate your support both of you thank you very much and and City staff what a great job they do every day so thank you any question. That's a quick comment Dale. Yes sir. I had the pleasure of being at the ribbon cutting for casual pint last week. Yes sir. What a great great establishment that is. I know it's more for the 20-30 kids but I can guarantee you that I'm gonna go over on occasion than the hoist one so they did a great job with it. It's an ordinance approving request for a rezoning from heavy commercial to a general commercial heavy commercial CGCH zoning district to the general commercial CG zoning district generally located along the northwest side of executive drive between office part drive and partly drive on 1.01 o acres, John, if you would take us through this. Okay, you just described it. I won't repeat all of that that you just said, but it is rezoning from from general commercial heavy commercial, which is a combination district to the general commercial district. You can see the aerial photo there. The future land use map does designate this entire area as commercial, so the rezoning proposed is consistent with that

[1:16:34] commercial designation. You can see here that there is a portion of the property is zoned, well we're talking about the back piece here, it's a couple of different zonings and as you may know that there's an office building and there was until recently a restaurant food truck actually in the back which is part of the reason that prompted this rezoning. You can see the pit barbecue side at the back they are relocating to a permanent structure on Sherwood and so I've been told that they are no longer there as the food truck but again as of this case being brought forward they were still located on the side as I mentioned the office buildings up at the front of the side but basically this zoning would clean up the zoning of the property get rid of the CGCH and go straight to commercial zoning, the CG zoning. I will note that we believe that this is compatible with the area, as I've mentioned. There were some complaints about smoke from the barbecue restaurant affecting the nearby office buildings that, in fact, one office building asserted that they lost a tenant because of the complaints about the smoke, although our zoning doesn't differentiate between restaurants that produce a lot of smoke and those that don't. and the Planning Commission did believe that, given all the information that this was, they recommended approval of this unanimously. As I mentioned, that restaurant is in the process of moving off the site. However, with this zoning, a new restaurant could move on to the site. This is something that would be allowed. We did send out our notifices, we did not receive any in favor, did receive that one in opposition. With that, I'd be happy to answer any questions. really you're minimizing what can be done. I mean CGCH is the very, that's the most

[1:18:34] lenient and you're actually taking it down a notch aren't you? That's correct it would allow fewer higher intensity uses on the side with this rezoning to a more straight commercial. Is this your area Charlotte? No it's Bill. Bill this yours this is your area would you like to move one way or another on this? I think I think it's actually a councilman Carter. I'm sorry. I'm going to drive all the way through. I'm sorry. What do you pay those on me? It's all right. Can you show the map on the area around it again and what it is zoned? Do you have heavy commercial behind it? Am I looking at this right? Yes. In fact, there's a lot of, there's some other areas within that whole corridor that are zoned either CGCH or straight heavy commercial, at one point I think this area was anticipated to allow more heavy commercial and maybe even industrial uses. As you know over time, it's transitioned to more commercial and actually mostly office uses. So the intensity level in that corridor has changed, but there is still some remnant zoning of the heavy commercial and I believe some industrial zoning farther down. But over time, those have been transitioning to more straight commercial or even office for the medical offices that are out there? I'm not in favor of limiting either. But in this case, with the majority of that area being the general commercial instead of heavy, I would think that it might be out of place if you did do a heavy. That's my thought. If I'm looking at this correct. Well, it's already heavy. Right. It's already heavy. They're trying to minimize it. The property owner is requesting the commercial zoning. Why would they do that, John?

[1:20:34] It's partly because of that restaurant that this, the heavy commercial does not allow the restaurant use for that barbecue. Charlotte, did you have a comment? I had a question and I was reading. Now I forgot my question. I'll ask it if John, John, I'm not picking on you. I asked you because The heavy commercial did not sorry. I hear that right did not allow for that restaurant or did it did not? It did not and as you can see the subject property is in yellow This back portion is part of that heavy commercial zoning. So they're basically asking to Clean up the zoning and as you can see the front part is the CGCH They want to take the whole property to the just a single zoning district and they've requested Cg instead where you have that box and red that darker that lighter red would continue all the way to executive Is that what I'm seeing? Where it says heavy commercial CH you had it actually it would go all the way down to executive Everything in yellow would become general commercial You can see this area is heavy commercial, but everything around it is the CgCH So it actually wouldn't be the same as anything around it But it's moving in the in the direction of of what the uses in that area are going to we're actually changing the zoning on about a third of that property All we're doing is changing that little portion behind the two buildings, correct? No, it's it's actually changing the entire property from CH on this part and from CG CH on this part So it's changing the whole property, but it would all change to CG. We'll change to CG. Correct. Okay, okay I remember my question now, John. I'm looking through and reading, and by the way, I do not like the new system where we can't

Yes, this is a rezoning, and as you mentioned, it is rezoning to a planned development to allow for a women's shelter, and I think we're moving towards getting to that that item. But basically, the current zoning on the property is CGCH. And the primary reason for a planned development, as you can see is a previously was a nursing home and you can see it's built right up to the property lines. There's not on-site parking so there are a number of things that if this were built today it would have to meet some standards that as an existing building as it's been built it just can't meet those standards. So the plan development is intended to allow them to use the building as is and as you'll see it does require a little bit of things like parking but not as much as would normally be required because I don't know if you can tell really here but there is on-street parking normally we don't allow on-street parking to count towards required parking but again when this was built that head-in on-street parking was a large part of the parking that they provided and so this PD would basically accommodate for that. The future land use map does show this area is commercial so a shelter like they're proposing is consistent with

[1:26:42] that. It is currently zone CGCH, as I mentioned. Here you can see the side, the existing building, all of that existing parking, again it's in the street right of way, but it is head-in parking that provides quite a bit of parking for the property. And before I get off of that, there is a paved area back here. What the PD would require them to do is is pave a driveway to get back to that. That would provides some off-street parking on the side itself and the applicants are okay with that. Just a few pictures of the facility. This is that what will become the parking area. Again this is we believe it's compatible with our plans and the zoning ordinance as well as the surrounding area. This has been an institutional type use in the past and they just proposed to convert that to another type of institutional use. No other problems that we foresee it is on a major street that would provide for the any traffic that this might generate which shouldn't be a large volume of traffic. We did send out our notifications, did not receive any responses in favor or against. The Planning Commission did recommend approval unanimously on this case and staff does also recommend approval subject to those 10 conditions that are listed in the plan development. I'm sorry, that should be five conditions. You can read, I'm not gonna read through all of those, but again, the primary ones are reducing the front set back, so the building doesn't have to be set back. Again, it's an existing building that's already there with a maximum occupancy of 53 and a minimum of 32 parking spaces. With that, I'd be happy to answer any questions. I actually attended the planning commission meeting when this was presented at this is a great opportunity for a needed service in San Angelo and I certainly applaud the people that are coming forward and I'm going to operate this.

I have a comment I had the opportunity back in October to tour the facility with the owners and to hear of their plan and what they're trying to do and going to do and I want to state that they have conveyed to me that their experience working with Ms. Guerrero has been good and very appreciative to answer their needs their questions when They really didn't know where to get answers and they got them from you, so I wanted to point that out. I agree with Harry, it does fit a need in San Angelo. It does provide, whether you wanna call it a safe harbor but a way to get back into the community and it also makes use of an existing facility in San Angelo and brings it back, puts it on the tax rolls in a much better fashion. So I definitely agree with the efforts and what they're trying to do here. I also had the opportunity to tour this facility with Mr. Alan Morse and I just want to thank him for having the passion to provide these opportunities for the women and children of our community to have a place to stay as like Ms. Charlotte said and I say harbor, I'll prove this 100%. It's a great passion that he has in a facility that he has there, too. Any comments? Well, I've been driving past this place for 50 plus years. And when they made you more abandoned it, it was I hated to see it staying there empty. So I think it's good to have a place for women and children that need help. So. Yeah, I just wanted to say that, OK, it was a facility there before and with no problems from that and I can't see any problems now with with this new use it's far away

Item number J is the first public hearing and consideration of an ordinance in meeting chapter 10 of the Code of Ordinance to decrease the speed limit on shirts boulevard beginning at the north boundary of Goodfellow Air Force Base and extending south to the south boundary of Goodfellow Air Force Base from 20 miles per hour to 25 miles per hour and this this road is on and in the base so really this is kind of a this is just housekeeping isn't it? Yes, this is really just housekeeping. I mean this entire stretch of street is maintained and you know pretty much owned by the Goodfellow It's just kind of a technicality that we have as far as who owns the right of way and you know between the city and the Homeland Security and things like that It's just you know, it's just a like you said just a clean up item. Listen, after all of the STR calls, I was tickled to death to get a trash call Sunday. I love talking trash. Consider the following items related to Solid Waste Services, authorizing city manager or designee

[1:32:59] to negotiate and execute all related documents. You want to take these one at a time, am I correct, Shane? I'll give you a presentation kind of that encompasses the whole thing and then at the very end we'll ask Yell to take these one motion at a time, yes sir. Well I'll read all three of them but we will need to vote on this. One, two, and three take a separate vote on each one. So is everyone clear on that? Item number one is approval of an amendment to the special exclusive contract for solid waste collection and disposal services section eight titled duties of provider with public services of Texas LTD providing every other week both pick up and every other week collection of recycles. Item number two will be the first public hearing and consideration in order to amend Section A8017 change. Charge for collection of garbage and trash and item number three is the first public hearing and consideration in order to amend Chapter 1104.006. Duties of the residential customer. Shane, you have the floor, sir. Thank you, Mayor, City Council. If you remember back in November, we came to y'all with a a report on our findings from the all the surveys that we did, the citizen surveys and y'all directed me to move forward with basically as little a change to the existing services possible, but we needed to clean up the bulk the bulk issues that we have with the bulk disposal and of course primarily that was landscape waste yard waste and so So the major issues that we heard out there were with the Landscaping Yardways. So with that, we went forward and worked with Republic and we have the following proposal for City Council. The items that we would amend on the contract would be to keep the trash collection the same as we have it right now, one time per week, trash collection in the 96-gallon brown cart. We would also, at that time, propose to move to the other week recycling collection like we had talked about a year or so ago, however long that's been now, but with that what we

[1:35:04] would do on the bulk collection is is that we would add an every other week bulk collection to that. So we would actually go from this week would be recycling collection, the next week would be bulk, the following week would be recycling, the following week would be bulk. And so it would take the place of the, you know, the bulk collection would take the place of the recycling collection. And with that, that should, everybody knows it's trash day, is when you set out your book waste, it's trash day. And so it would go with your trash. And so that way everybody knows every week, every time, every other week, it is book collection and everybody will know that and you set it out with your trash can. So hopefully that would stop a lot of the confusion that we're having with when it wins my book collection, trying to find yourself on the map, all those things, all those issues would kind of go away at that point. With that, kind of bringing a more comprehensive package to you than just this, other things that we would like to do, and of course, one thing. There's still a lot of money. I'm going to cover everything kind of at once, and we will all summarize. My last few slides will be a summary of everything for y'all to vote on specifically when it's time. And also, last time we discussed this, we said if they needed to recycle containers that we would, that would be allowed at no extra charge. That's correct. And we will deliver those within the first six months, hopefully everybody after the first six months of this program before the first six months is over, you would realize if you need an additional recycling can or not. And you were probably going to cover that and I got ahead of you. Yes, sir, but that's good. Go ahead. As good a time as you need to bring that forward. One of the things in a bigger package that we're trying to bring here is to allow Republic services to utilize the centralized customer service center. And what this is, and instead of the standard call in service that they have, that's the eight to five here in the city of Snayslow, this would allow them to pass this on to the customer service

[1:37:06] centers located in off the east coast in the central US, and then also in the Western time zone. So that would increase customer service hours from 7 AM to 7 PM daily. And so that would help people have the time to be able to call in and reach somebody at one of these customer service centers. Now, with that caveat, we did state that they must maintain a customer service representative in the office here in San Angelo, Texas at all times. When their doors are open, there needs to be a customer service representative sitting there able to take walk-ins. If somebody, if you're not satisfied with what you're getting with them on the phone, you can walk down there, walk in the doors at 1422 Hughes Street and go in there and you can talk to somebody that can help you there. So they must maintain that with this. A couple of services that we'd like to see added from the city standpoint and also from the Republic standpoint is to add a four cubic yard temporary container for residential cleanup. This would be a basically allow residence. a long pass is a way and we need to clean the house or something like that. It would allow for a residential homeowner to actually get a smaller container than having to get a large roll off back up into the front yard of the house. Another thing that I'd like to add for new services would be a 15 cubic yard roll off container for commercial use. Currently under our current ordinance, this is not allowed, this is just an additional size container it's a smaller container for commercial use. One of the things that Republic would also like to see us add to our fees and into the contract would be for those industrial customers that have the roll-offs. Any time that they go over the the wait limits the text out wait limits for that roll-off container

[1:39:07] that they would be allowed to add a $50 per ton charge to that container so that that they can recoup one. You know, it's, it is somewhat of a punitive type fee, but it's one of those things that if they are overweight then they are violating traffic laws and they are also adding more wear and tear to our streets, more wear and tear to their equipment and things like that. So they would like to add this charge in our fees and in the contract. And also for our commercial containers, like to add an extra yardage fee, when the containers are overloaded, this is Ms. Farm. I agree with everything you're saying. I just want to know why can't we charge residential customers for overloaded in bags flowing all around out there? We could add that charge. We're hoping that we're hoping with the proposal going to an ever other weekbook collection that hopefully some of this would help significantly in that matter as well too. as well too. And I will add just touching base on that again that even with the ever other week bulk collection that we're talking about that we will still keep the citizens' redumping program where you once a month you can take your water bill and go to the landfill and use it as well. But again extra yardage for those thirty dollars per occurrence what that would do they would take a picture of that identify that container on that day and they would the public would build that customer directly for that. Excuse me Shane, that would also assist the city as far as clean up when you have those overlaid containers. Of course, we know where that trash ends up, especially when it's windy outside. It's blowing all over the place, so it makes it a little bit trasher, so that definitely would help resolve that. And definitely help with the wind blowing waste issues as well too, thank you. And again, this is just kind of reiterating it,

[1:41:11] but this is actually good, we're going into the appendix for the fee schedule. Again, we've already talked about these, But this is just where we add it to the fee schedule. Again, 4 cubic yard container for the fee schedule. For the residential container, it'd be $52.94 for the delivery and removal fee, plus $38.12 per collection. And that would just go right into our, it's actually a portion of it. We're just using the same fees that were already established. But we're identifying this for a temporary residential container. And then you can see the charges for the 15 cubic yard roll-off container there as well too. Again, this would go into our fee schedule. One of the things that Republic has asked for and returned for the additional service for the for the bulk collection, the added bulk collection that they're doing is to add a one ton minimum on the landfill tipping fees. This is fairly standard. This was actually gonna be a part of the original contract. somehow got inadvertently left out in the original contract, and they have been pro-rating ever since, but they would like to add this back into the contract. This is pretty standard across most landfills across the country, and again, it was a part of our old contract, inadvertently got left off this, they have asked to have this back. We believe under the current proposal, when we're talking about the citizens of San Angelo and how that may affect them, we believe that from a residential standpoint, that it would be very minimal if any impact on them at all as going to an ever other week boat collection where you would get basically, I have cubic yards worth of capacity every other week for a boat pickup, and then also your once a month free dump at the landfill on the Citizens Free Dumping Program with your water bill. That basically, three plus times a month,

[1:43:13] you're gonna basically get a lot of bulk waste ability to dispose of that at the existing charge that we're charging residential customers. Jane, can you explain what this tipping landfill tipping is? Landfill tipping, when you go across, when you go out to the landfill and you go across the scales, you're weighed as you go across the scales. And that's what we call a tipping fee is is the the weight that you go across, how much you're leaving at the landfill, you're charged basically per ton. And we've been pro-rating that ever since the new contractor, we haven't, Republic has, they've been pro-rating that as we're, as they're going along, but they would like to have, if you go across to have a one ton minimum, be charged at least the minimum, one ton minimum rate, which is currently 37, 48 at the landfill, that would be a minimum charge as you go across the scale. That's for residential customers also? That would be for anybody that goes across the scales out there. And again, and that's why we're saying from the residential side, we would believe that with all of the bulk, with every other week bulk, and with the Citizens for Dumping program still in place, the once a month with your water bill, we don't see very many circumstances where anybody would have to pay that as they go into the landfill from a residential standpoint. Yeah, if you have your utility bill. If you have your utility bill, it's free. I have another question. Okay, sir. One thing that was mentioned to me a while back was that I don't know whether this was true or not, but there was the small bulk containers both containers and set on a residential lock were almost the same price as as the large containers Understand what I mean

[1:45:15] the For both pick up some people have a container on their front lawn The if the only container that they were allowed For the last year and a half has been a basically a roll-off container or even for residential use, and that's why we have gone back in or proposing to go back in with this one and add the ability for a homeowner to utilize a 4 cubic yard container instead of having to get a big 15 or 20 yard or whatever size roll off to put in the front yard. So I'm not necessarily sure it hasn't again in the last year that hasn't been allowed to have a container at your house. so I'm not sure where that would come from. Okay, I need clarification to bulk pick up. That's just set out in bags or if it's an old- If it's yard clipping, yard clippings, leaves, when you rake your leaves, you bag them, you set those up there. If you're pruning, trimming your limbs and you can put those in four foot bundles and stack them up next to it. four-foot length and bundled packages you can set them next to it, couches, love seats, stoves, you name it, that can all be in your book pickup. Mattress is also. I do not believe mattresses are allowed in book pickup. I would have to, we do have a list that is in our, that's in the current contract, is what's allowable in book and what's not allowable in book book. Mattress is maybe, I'd have to. They are? Yes, mattresses are allowable. I'd have to go back and actually look at the list in the contract, so That's fine. Thank you. Okay, and one of the things that City staff that we would ask at kind of taking this in a more comprehensive approach is as we deal

[1:47:15] It dealt with a lot of yard waste and we dealt with a lot of contamination Still deal with a lot of contamination in our recycling containers residential recycling containers one thing that we would ask in amongst all of these more comprehensive package is to add within our ordinance the ability for the city solid waste administrator to basically if we have repeat offenders and we have identified those repeat offenders and we've talked to them and we've visited with them that if they continue to abuse the recycling container that the city would have the ability to remove that recycling container from their property. Again, with the contamination rates that we're seeing, we do know that we have habitual abusers of the recycling program that continue to misuse the recycling carts and we would like that ability, the authority, to remove those carts from the premises so they can no longer contaminate the recycling. Again, this wouldn't be a, I and we see something one time we would again it would be we would use our our judgment but again it would be after we have visited with these people one or two or three times to ensure that we have definitely told them do not abuse your recycling cart. What you're saying is let's say a street as long as sunset all of sunset if there were one or two habitual that continually contaminate in their recycling it contaminates the entire street depending on the truck it could and what they're putting in there. That's going against our tonnage right because I've got to take that out of here. That's correct and it's basically when we start talking with all of the yard waste that we've had in our contamination. The yard waste is what really it distributes out even further into the recyclables and so

[1:49:16] when they get it over there to butts it's one of those things that basically the way they can really remove it is take a front end loader and just take out that section of recyclables to get rid of all the yard waste that's been intermingled within all the recyclables. And then of course too that would also give the city solid waste administrator the ability in time if somebody says hey yeah I was we were doing it wrong we'd like have our recyclables back we're gonna do it right that would give us the authority to also reestablish that service as well to to that residential customer and that's basically what this ordinance says in a nutshell so I have one other question one is there was and I made the comment that okay larger family okay is it still going to cost them five dollars for next year's container an extra trash container yes sir that is still they couldn't give any relief to a large families you're giving them bulk pick up every other week yes sir I mean we were given book pick up every other week one and then to well there how do you define large family who leases it ten to twenty kids yeah it's not saying that it couldn't happen it would just be difficult to happen and hopefully the book collections every other week would would allow for some relief in that area as well too okay thank you And you also touched on as far as the recyclables one of the biggest issues we have is the contamination And you mentioned the yard waste a while ago one thing that will assist is the other every other month bulk pick up because a lot of it That we're seeing is some of that yard waste that goes into the There's no reason for a person to put yard waste as a disciple container from here on out Because they'll have the option every other week to have it out on the curb and yeah Or do you have a question? Yes, I do It's actually a comment, because I know what Shane's going to tell me.

[1:51:19] The last time we talked about this, I put a proposal out there that I thought had some merit on it, and I still think it may. I personally do not use this bulk pickup, never used it since Republic started the new contract. I remodeled a bathroom probably five years ago, and I had a trailer full of stuff that that I went out there with my water bill. So a bulk pickup to me doesn't mean anything. I don't do that. When I trim trees or rake leaves in two or three weeks, I can get it in my trash can and they can haul it off. So it really doesn't bother me one way or the other. I'd like to still see us consider leaving it four times a year, but letting the citizen call in and between the citizen and the republic, They figure out a day that that ball pickup can be there and then they take care of it. I believe that as far as Harry just because you don't do the ball doesn't mean that a lot of people in town do not need this. I have seen it through my district that people are in need of ball and it will be beneficial for it to be every other week. The thing about it is they have it and it's gone in the alley. So now that if once we get it on every other week, I believe that the yards and the alleys would be a little bit cleaner, we're going to be, it's going to be something that you just are ready to go the week that it's ready, you don't have to wait. And the calling, you're never going to, I mean, when they were trying to figure out when it was their turn for the bulk to come around, the calling was never in the right time and some people do not have computers that they could have looked it up. So for this reason, I am very much forward to that every other week of recycling and block pickup. I would like to say that. I'll need to be identified before you start speaking.

[1:53:19] Okay. You want to speak, raise your hand and I will identify you. Bill? I, you know, along with Lucy's saying the last time I trimmed my trees, I got two pickup truck loads. So I would appreciate it. You know, I can take one of them and then I can put the rest out, you know, one wound up and cut it up and one wound up and put it out for the bulk pickup. So I think that's a good idea. Yeah, the comments, Lane. No, personally, the every other week bulk pickup would satisfy me because between my parents and my rent houses, 16 houses, we bag our grass, we bag our leaves. And every other week when we mow, we have our containers bulging out. But is that going to be the same across the entire city? Every other week, personally, I would do every other month or every month with a call in that way, their trucks are not going down the street, pause there. Do you know with the percentage of use of bolt pickup is right now across the board. I do know people do utilize it but I would and I do not know what that usage is but I would make the assumption that it's fairly low right now because people do not know when it is and when to schedule it when to have it out so I don't believe people are actually utilizing the program the way they the way they will if they have an identifiable date that they know that the bulk is going to be there. So I guess the conclusion that I'm coming to in my head that every other week bulk collection is going to be a little bit excessive for the trade off of every other week recycling. I would be satisfied with a monthly bulk because we don't want the decrease in service or any

[1:55:19] accusation for the decrease of recycling going every other week. I will say this for the record. I don't want to make a decision today because I didn't walk the streets for six months and wear out some shoes just to, you know, wear a presentation and it's done. I want to get this as finite as possible to where the citizens are happy and small businesses are happy because right now our contractors and our builders are being overran with having to use a certain dumpster for their business. So this is something that I'm not going to take lightly and make a decision today. This is a great start. We have come a long way, but I still, in the very near future, would like to make the decision, but not today, if everybody is on consensus of that. Got it? I'm totally against having people call in for a date to pick up their bulks, you know, those trucks coming down the alley make a lot of noise. And sometimes they drive a little too fast and there's men on the back. And if I know that it's trash day, my trash day, it's great, it's wonderful. But to have people call in and say, well, next Monday, Tuesday, or Wednesday, or Thursday, I want you to come by and pick up, you know, bulk, that's a, I don't know that they've called and I don't know a reason for the truck to be back there and the men you know to be back there so I like knowing when they're going to be there a designated time and it just seems like that's getting a little bit too much of a personal service for the price that we're getting for republic to have to let the people decide which day about pick up is going to come to their house. So I don't like that. The other thing is I need to ask because I have a huge argument going with family members

[1:57:22] and in my household, I have been insisting that yard clippings, tree clippings, it has to be broken down no more than this length and has to be bagged. Is that correct or am I wrong in putting this punishment on my relatives' unduly that they have to bag these tree limbs? The tree limbs can actually be, as long as they're in four foot lengths and they're in bundles, that's all it takes. They do not actually have to be bagged. They can be bundled and set out for bulk waste. Now if you're going to put them in your container, they do not have to necessarily be bagged to go in the container, but they need to fit in the container where the lid will close. I have the waste container and then the recycle container and my blue container where I put my bulk, which I call my tree limbs, you know, and stuff like that. I put it out there. They come on their designated day. They may not get the bulk or they may not get the recycle, but they get the waste every week. That's fine with me. I don't have a problem with the proposals and it seems pretty uniform as presented. But I don't have a problem either with Lane Wanting Time to look at this and peruse and handle it and chew it up. I know you might not want to come but I would love to one more town hall meeting for people in my district and all over to come and tell me what they think about this exact proposal. Eric? That is one of my clarification to Charlotte. Other cities have a call in that it's not an issue. I can support this but I want people to know that since a good majority of the people in my district don't use the bulk pickup on a regular basis. I think the four is already, and if you call in, then that's between republic and that citizen. So I can support this one if that's what the majority thinks.

[1:59:23] Lucy? I would like to go ahead and make a decision. I think that we have asked, go back and forth and back and forth, you're coming before us with this proposition. Um, I haven't used bulk and I think I'm paying for something that I'm not getting the service for. And I just don't want to wait anymore and keep on paying and not. And I'm sure some of the people are feeling the same way that they are not getting what they're paying for because we haven't made a decision or they have to call or they have to find out what date. So I would really like to see something being done today. Yep. Okay, clarification, the only cost increase in this would be for people who are violating what they're supposed to do, whether they're commercial or whether they're residential, the only cost increase is for violators? Yes, and what we've got, it's actually, it would be an additional charge is what we would add to our fee schedule would be the additional charge to allow them to for the extra yardage fee and for the industrial roll-off fee. We're just adding that charge to it. If they go over ten tons on the industrial roll-off or if their dumpster is overloaded, that's correct. Those are the additional fees. Now we are adding additional services within the fee and the contract as well too, the 15 cubic yard and the four cubic yard. Those are actually additional services that will be added. There's not an increase in fee, it's just an additional fees will be added for those additional services. Okay, you know, this is not gonna satisfy everyone, but I think right now it's a good compromise. And this is the first reading. And if somebody wants to have a town hall

[2:01:25] to discuss it before the next reading, that's possible. Okay, thank you. We'll clarify that if we want to move forward with this today and we don't want to go and we're going to start going down through. If you vote for contract changes today, that's just one reading. Now, all the ordinances and fee schedule changes, those are two readings, that's correct. The comments from Council? Going along the lines of the one ton minimum, I would like to see because if the truck bed comes in there, there they're not going to have anywhere close to one ton and a $37 charge if I'm correct for one ton is excessive especially if someone is coming from outside the city limits and they're going to have to pay they don't have their water bill if their scales are not registering that is that something that we need to recalibrate to get a exact measurement or can we do a a half-ton charge, something goes on. There can be. And the thought process was, you know, for those that live outside the city of Snagelower, outside, even the county of Tom Green County, for that minimum one-ton charge, of course, I think mayors alluded to this before. They don't necessarily pay city taxes. And so this is a city-owned landfill. And for the citizens, we're covering the citizens, but there's for everybody that's outside the county or outside the city and outside the county that don't pay local taxes, it's we would be giving them a break versus citizens. But again, that's, that was something that the mayor had brought forward to me, but again, that's what, that's council's discretion, not mine, so. And the mayor also brought forth another point when we talked about that. And I agree with Lane. I think, I think one time minimum is success. And I would rather see a half ton minimum.

[2:03:25] And it's not going to be often, but occasionally, somebody's going to have a couch that they need to kick off. If they're going to charge them $37 kick that couch off, they're going to drive down the road and kick it off in the long, the bargain. Yes, sir. They do that already. I think $37 is excessive. And I would approve a half ton minimum, which would be about $17. I don't have a problem with that. But I'm not going to support a one ton minimum. That's too much. And I realize that with our bulk pickup twice a month, that we're going to solve a lot of these problems. But still, I don't see any reason to be punitive. One other question I had, I don't know what the state charges these wait boys when they pull you over, what do they charge you when you're one ton overloaded? We're charging $50 per tonne for an overload fee. But what does the state charge when they pull us over and we're overloaded? I cannot, and I sure don't move. I don't have any idea. And with this Zika mosquito scare that we had, having all of these bags of wet moly, long clippings in the backyard, it worried me because this could have been a very serious health thing. So by making it every other week on the bulk pickup, they can load their brown can up, and if they've got 10 sacks that they wanna throw beside it, they'll pick it up. But under the rules now, if it's not in that can, they're not gonna pick it up. So I really think this is an excellent idea. And we've got about half of our people that do bag and get rid of their log clippings. So I think this is, I will approve everything on this and support everything except that one time now. Mr. Mayor. Charlotte. I do want to add to that every phone call that I have received or email that I have received about excessive bags, log clippings, you know, left 20 bags, 30 bags, every call that I've called Republic about, they've gone out and picked them up. And I think that's commendable to Republic if the citizen lets me know that, hey, they didn't pick these up, they've been here, and I've called them, they go get them. And I've referred them to Jeremy, and Jeremy's taken care of the problems. And I appreciate Jeremy, and I appreciate Trashway, they've worked with our people, but we don't need these old bags laying around with this Zika. I'll be commenting at this time. The new one-ton minimum is going to impact quite a few people. I mean, quite a few small businesses that are hauling in the back of their truck. That's cost to them. We all know what that is. Whether you have 10 pounds or 2,000 pounds, you're going to pay the same. And that adds up if you're bringing loads starting a small business. The overload fee on commercial dumpsters, That's not, having an overloaded dumpster is an issue, but putting on fees time after time without courtesy calls and that sort of thing. This is an authorization to put those fees on. That also can hurt a business trying to get themselves going here. He consolidated customer care center. While that's a cost savings for Republic, it means reduced service locally. I know that having someone you can talk to, call anytime, and they know your area and know what you need there, that's a big deal, and this is going to reduce that, so let's just be clear. It's just clarity on what this means. I don't think any of these people wanted these open forums, it was all about service. Every other week, bolt pickup, people were concerned, that's the main discussion here, and that's great. we can get both pick up up if that's what people want. But let's also be clear that that's not reasonable. No cities do that every other week pick up. It's gonna change because it will, because not everybody's gonna need 26 times of pick up. So let's be clear that this is not, it makes it look like they're doing all this extra service when in reality that's not the case. We're going to every other week recycling,

[2:09:26] that's saving them money just to be very straight up. And every other week vote pick up is not going to stick around. That's going to change. And that's fine. But let's just not say that we're getting all this great service. There are other fees here. So if we're going to pass this and changes are good, but let's be real clear that it's not like we're getting all this great service. These are new fees. And in a community now when there's no choice on who you have for construction temporary pick up now for builders and construction. There are situations when having a choice is good. And sometimes this might be the time when having a choice for these commercial businesses might be a good thing. We're recouping. There's recoup of cost here. Let's not get ourselves. So as long as we know that, then go for it. But let's be real clear as we move forward. Thank you. any other comment I might further add that we've been dealing with this this contract was signed on July 31st of 2014 we're almost three years into a tenure contract with Republic and Lane I must again disagree with you we have had more discussion and public meetings on this trash thing than anything I've dealt with in my 14 years we have beat this horse to death and it's time to make a decision. Personally I like everything you've done as I said except that one half time so I'm gonna ask that you amend that to one half ton as far as the minimum charge because Christie's right on that so if we can amend that to a minimum of one half ton I'll support it if not I will vote against that one third of our proposal. We mayor the way this and as we move forward here of course we have our recommendations on the or for your approval on our contract wording changes but how we've

[2:11:31] written this it does still allow us if you give me direction we can still do some negotiating after the fact and Daniel can sign this so if that's something that you put in the form of a motion then we can we can address that with republic not to say that they will be be willing to accept those terms, and so we may be coming back again if we cannot come to agreement with those terms, but that's something that you can definitely do in your motion. Moving forward recommendation for our first item to vote on is our contract changes, and again, this is just kind of a recap of what we're looking at every other week, recycle and bulk collection, so that will go to every week. Allow Republic to utilize the Centralized Customer Service Center at additional, the the additional four cubic yard residential container in the 15 cubic yard roll off container. Add an extra yardage fee for commercial containers that are overloaded, add the 10 ton industrial charge for roll off containers, exceeding the weight limits. And yup, that should be. Let's vote on the first. It should be the first one, so. I don't have a problem making a recommendation to accept item number one approval with the exception of the mayor's recommendation. I will include that in my motion to change that that on this one. We still have a second reading on the fees ordinance, which is like Shane said, also includes this particular fee. So it is possible for us to approve the contract next time and have second reading on both of those ordinances, then they all go into effect at the same time. So the ordinance is first reading. The contract is approved as soon as you guys vote. The contract pertains to every other week recycling for the bulk. Correct? I'm sorry. The part for the contract is pertaining to the every other

[2:15:35] week for every other bulk. Yes, all creating. That is the one issue that I need to touch on with you. If we amend the contract and I'm not being able to go back to the people, there's a problem. We've sent out surveys, we had town hall meetings, people told us what they wanted. And this is designed according to what they told us that they wanted. I don't see that holding off another week or another town hall meeting is going to make any difference. We have had the town hall meetings and we did what the people asked for and that is dis-ordinates. Charlotte. Mr. Mayor, I with all respect Lane hadn't been here three years the amount of time that we've been working on it And I truly respect him wanting to get with his constituents But I still feel between now and the really he will have the time he needs before we come back to next council meeting Quick question Teresa. I know that the contract itself is tied to The the ordinance actually I mean we started looking at the half ton issue and so forth So it's all tied together. So really, in all reality, we really possibly couldn't pass a contract today because everything else has to be worked out. And it's all... Again, we can pass the contract with the amendment. So we can pass the contract saying, but only with a half-ton. That's what you're saying. Okay. Right. We could either do that this time or we could wait till next time to do that. But for instance, if Shane goes back to Republic in the next two weeks and tries to work out the half-ton fee and that doesn't work, he can still bring the contract back to you a second time, next time, with the one-ton fee and see if you approve that. The number one concern that I have had since this has been on the agenda is the bulk every other week for the majority is going to be excessive.

[2:17:35] Is that going to truly benefit the whole town? It would benefit me perfectly, but as an entire town who is going to utilize the bulk pickup, we could be having a decrease in service because of people not utilizing that. It would be great if people stopped contaminating the recycling to where we have more than 65% utilization of that. It would be great if people could have more bulk pickup. But there's, in my opinion, I think there is a part that is going to be excessive. And I think this might be reaching that as a trade off. Yeah, one thing, and I think Councilman Thomas, brought it up a while ago that there's nothing I don't believe it's gonna be perfect for everybody. It's gonna suit certain people, it's not gonna be usable, And it's not going to suit other people. And I don't know that we could ever create an ordinance or a contract or an amendment that's going to be perfect for every single person in this town. Hopefully, what we're trying to do in three-year-olds guidance is to create something that is acceptable by everyone and usable by everyone. And again, hopefully we're trying to get that done through year-olds guidance. And again, we're here to serve y'all and try to make the best out of everything that we can. So again, we're here for y'all, and so whatever y'all want us to do, we'll tackle. I have one question for Robert Sorrels. He's still back there. When I called Brian's office at the City Hall, he can answer from there. When I called Brian's office at the City Hall, I listened to about five minutes of punch one, two, three. So I know when I pick up the phone, punch five,

Item number C is Consider Resolution of General Support for construction of low-income housing tax credit, projects, Kirby Commons by Zimmerman Properties LLC to construct an 80-unit affordable housing apartment complex for the general public on the corner of 29th Street in MLK and San Angelo States by four corners development LLC to construct a 48 to 60 apartment complex for elderly renters near Serber and Baker Street, Bob Salas. Good morning. Every year developers compete for tax credits to build affordable housing across the state. It's a program out of Austin through the Texas Department of Housing and Community Affairs who publishes what we call the qualified allocation plan or QAP which really sets the rules for the program year. We are in Region 12 urban and we compete with Odessa and Midland, and we have really been much more successful than we have in the past, but we're making some headway. We won, in fact, last year's allocation for Kirby Park Villas. I believe we have a very good chance of winning this year, and we want their support. We want city support. We have two projects this year, the San Angelo Estates by Four Corners Development, Kirby Comments by Zimmerman properties LLC. Both of these developers are very capable and experienced to help us meet the additional affordable housing need where we have about 27% of households here in San Angelo experiencing what we call a cost of birding. That cost of burden means that 30 the 30% of the income goes

[2:25:41] towards housing. Half of those experience a 50% cost burden so you can see there's a need. A recent market study also show that we need about 6,000 affordable housing units for seniors. So there certainly is a need. The San Angeles States is proposed to be a 60 unit complex, 21 in two bedrooms. It is elderly restricted. That means 55 and older. They'll have a community building, walking trails, a garden area, some barbecue areas, and a covered door seating. This is what they're going to look like. You can see they're going to be single-story quadplexus. This is only about K on 29th. This is not. This is right going to be a fact. It's right here. You can see where it's going to be. It's going to be right here. It's right down the street from this location, in fact, with an entrance right here at Baker Street. And that's that's the San Angela Estates current comments is going to be 72 to 80 units 2 and 3 bedroom 17 will be at market rate I mean there's no income requirements it's open to the public it there's no age restrictions they'll have a community building so I'll pull in the playground and they'll look like this you can see they're pretty attractive and this is the location last year we want the Kirby Park villas and this is going to be a sister, a partner to this, to the one we won last year, it's going to be located just east, just west of the Kirby Park Villas. We did hold a housing forum for citizens to provide

[2:27:41] a little bit of input, some information. We did get two individuals speak against the St. Angela states. They expressed a couple of concerns. One is for potential increase in traffic, and the other one was the fear of increased taxes. Of course, since the project is earmarked for elderly, it's considered low-density, and therefore there'll be very minimal impact on traffic. And since we don't, since rentals don't directly affect housing property values, there should be minimal impact on that as well. There were no concerns expressed for curvy comments, and we're asking Council to approve bold resolutions for both projects. The question isn't it's my understanding and correct me I'm wrong that the San Angelo states is actually a homegrown guy from here that's the developer of this project. I don't believe so they are actually we they have a representative out of Austin but I think they're out of Oklahoma I believe they do a lot of work here in Texas. And we do have representatives of both here to get answers on your questions, but no, that's not, they're not, I don't believe they're home grown. You maybe think of a different person. They didn't, they weren't able to meet the deadlines. I got a call from, I think Bill Ford called me. No, it's not someone I know. So it's this, the Baker Street property has been owned by the same family for a number of years. And even though he doesn't live here now, he has developed properties here. Oh, well, I think they'll be They'll be trying to purchase that property from him, but he's not going to be the developer. Just a real quick question. Got two properties here, and the need is in San Angelo. Any danger of San Angelo losing out on some of these tax

[2:29:42] credits because we're approving both of them? Negative. In fact, the points are the points based on the QAP, like I mentioned. What will happen if you don't approve, they'll lose 17 points and they'll be dead in the water. there will not be competitive if I can tell you that. They need city support. We're talking about buying big lots of affordable So it's a lot of time it's timing I'm sure developers would love to find one in real v-star area Well, we may want to do eventually though Mary's to consider expanding these areas Maybe done the role a little bit to provide a bit more flexibility on locations Snickers yes And, of course, I say that tongue in cheek, because I remember about two years ago, we tried to propose a middle income, but in fact, we had two of them. One was out by Sam's, and one was over on Valley View. And the people came out in mass opposing these things. I don't have a problem with putting them in the district where there's already five, because

[2:31:42] there is a need. But it's time we started spreading these things around town and letting everyone in town enjoy these government programs instead of putting them all in one spot. I'd like to answer your question directly. Here is what happens, and the reason that we focus on certain areas. Now, the Texas Department of Housing and Community Affairs sits out a qualified allocation plan every year, and every year the rules change whatever reason the state changes then says well we know better than the developers or the city or anyone else where your housing should go and they assign certain point values to levels of criteria. Now the letter of sport that we're asking for today is worth 17 points. Each of the applications that go in are probably going to be separated by one or two points. That's how competitive it is but what they do is they'll go in and say given certain census tracks here are certain point values that are for each one if you have so many points for schools quality of schools or whatever maybe you get certain points and and on down the road so what that does is that sets these aside by census tracks and this year these two census tracks that the two developers are vying for meet the criteria that the Texas Department of Housing Community Affairs has set out. They're having a planning session for the QAP for next year and I'm going to be at those meetings and I'm going to bring up your your concerns. Can I agree with you is that we should be dispersing housing across cities as

[2:33:42] as opposed to concentrating and the agency has caused us to concentrate in this particular area. And I'll be happy to work with your staff for this coming round of next year to make sure that it is dispersed and there is a logical way to do that. I'd appreciate that. I think they need to be spread out all over the city and not concentrated in one or two spots. Do have a motion to approve the idea. I need to make one more comment. Yes, sir. I mean you're going to be really happy with with what you you see there, and hopefully the second phase will get awarded, which is a wonderful location given the location with the Walmart and other services around it.

Item number D, consider authorizing the city manager as a designee to negotiate and execute a contract with Consul Valley Paul's to manage animal shelter adoptions not to exceed $60,000 and to execute related documents in accordance with RFP NSO 117. James Flores you have the floor server. Good morning Council City Management City staff James Flores a neighborhood and family services. Today's presentation is just that it's an opportunity for us to come forward and entertain adopting our local animal shelters adoption process out to one of our rescue partners. So the presentation is going to just basically describe the outsourcing of the animal adoptions. As you know, animal control is primary mission for any municipality shelter.

[2:37:47] Has not been our primary mission for about the last two years, but we want to get back into that primary mission. Adoptions are secondary mission. And since we've recognized this, I I think that's why we're standing here today is to kind of garner some support on the fact that we want to get back into our primary mission. We feel that the benefits of outsourcing this type of contract, it's going to provide adoption expertise, not that the staff has not done a wonderful job in that capacity, I think they've done a marvelous job, but for continuance in this capacity, keeping them with the nuances of the business of the adoption world and us not necessarily providing type of opportunity for staff, whether it be a monetary reason or not, we feel that somebody that does this has been doing this will further better serve the citizen than current staff in this role. We gain a two-for-one manpower increase. In this contract, we're getting two people for the price of what one does today. And it's huge to me from the one side because the guy that I could replace that currently does this and put him in an animal control capacity is equivalent to two or three guys. So it's a big big move for me. It frees up manpower to concentrate on animal control. Again that's not been our focus and that's not been our mission for the last 17-18 months and I think now after being there as long as we've been going through some of the things that we've gone through I think some of the issues that we are are not entertaining, need to be addressed, which is in the animal control field or world. This contract will provide adoption services per current processes and fee schedule. In other words, nothing's changing. We envision a seamless transition from current staff to the adoption agency that we would like to entertain the contract with. So they would still be the microchipping, scheduling spay, neuter surgeries, ensure rabies vaccinations.

[2:39:48] Again, all things that we're currently doing internally, this is something that someone else is gonna take over, which would free my mind power up in other capacities. Assist customers with pet point navigation, that's a big thing. As you know, we went live and went technologically, technologically based out at the shelter. It proved to be positive, proved to be very vital. You can view inventory from the comfort of your home versus driving out to the county. Match potential animals with customer needs. Again, this is where I think if we don't implement some type of training, some additional funds for staff, we can get kind of laxed and kind of get dated in this capacity. So we see this as a great opportunity for a rescue organization to match potential animals with customer needs, because there is a process. We don't like to see one come back once it's adopted. So there is a process that really needs to undertake to make sure that we've made the right decision or the customer's made the right decision for that forever. The animals they're going to have, you know, for 7, 10, 15 years. Contract requirements, basically it's a follow up with customer contact after adoption. This is huge. This is where we don't have time as a staff to do. Some people call it post surveys, whatever you want to call it, it's a phone call after you've experienced some type of scenario at the shelter. I love that and we just don't have the manpower in the hours to do that. And it's going to kind of let us know where we stand, what the perception is of the public of how we're doing. We currently don't offer that. So that's a big thing for myself. They're going to offer basic animal obedience, kindling, and housebreaking training. Again, we are short staffed. And we don't offer this type of scenarios for the citizen. Successful adoptions that stay together for a harmonious time do have some type of animal obedience training. Definitely some kindling, and of course housebreaking, because those three reasons are why some of my population exists as high as it does. Provide mandatory counseling for pet owners wishing to drop off pets at shelter.

[2:41:49] We do dabble in this currently as a staff. It's hit and miss. If we have the opportunity or we overhear a scenario of why somebody is relinquishing an animal and time allows or the customer flow allows, we do make it a point to meet with that individual kind of to the side one on one, find out what exactly the needs are of why they're bringing it in. Sometimes from a resource standpoint, we are able to keep that relationship together or even reunite. Something as so simple as offering them six months of food, from donated food that I receive. I do receive donations. I don't feed donations to our animals. We feed a local regimen from a local vendor. They coordinate weekend offsite adoption events. I think this is very vital. I believe in this, we've done this for the last two years. Very successful. Coordinate work with other rescue groups. So that's going to be key, it takes everybody in this business, it takes a shelter to make sure the animals are available for adoption and it takes rescue groups all over this town. We have four that we deal with every single day and our vision is this isn't going to cease if anything is going to grow, it will bring people closer together in my professional opinion so it's going to it's going to demand some coordination work with other rescue groups. The recommendation is request the approval to negotiate and execute a contract with Consul Valley Pals not to exceed $60,000 to manage animal adoptions. In this case, a request for proposals. We are required by state law to send, I'm sorry, to put a notification in the newspaper and to publish it for two weeks. For this particular procurement, we actually posted it in the newspaper twice, sent emails and notification letters to 501c3s that we were aware of, and then we also left this open for three weeks rather than the mandatory two. Bill? Did you get any proposals from any other organizations? No, sir. Some did kindly send an email of a no bid, but no other monetary value contracts were accepted, or were given to us. So nobody else bid on it. OK. I remember we talked about this, and were any of them critical of this? I'm sorry. Well, we're ending them critical of choosing pause. I'm sorry, Councilman Thompson, I'm not, I mean, any of these, I understand agencies. You said we're the critical of the choice of pause. Well, I mean, I, not, I mean, I didn't receive anything to that type of effect. So, I mean, I couldn't stand here and say that there weren't. But me personally, as a, as a guy that runs the shelter, I didn't receive, I had other rescue groups

So no, sir, that I can attest to, I didn't receive any type of feedback from that. I know most of y'all here and I just wanted to say most of y'all know that I took care of the late Eva Tucker for 23 years. I gave up my college and education and Eva Tucker was a very big supporter of the shelter, and she loved Paul's. And she had a kitty that we got, and on her lap, it was a black cat. And I don't know if that is why her stocks has split and multiplied through the years, but in 23 years I distributed over $15 million to the city with different programs. Since she has passed, I've already given over $7 million to different projects throughout this city, and we'll continue. Paul's is one of those that we love very much, and Eva named her cat Exxon. And Exxon is still living to this day, and is with one of the caretakers that helped me take care of Ms. Tucker. But there was only three things Ms. Tucker did in her life as you know every day. She watched Catholic Mass, she watched the city council meeting, and she would watch the news. And she admired each and every one of you for everything you do.

And of course, I'm in support of this. But I just wanted to make a couple of statements. It's important for me to share with you the importance that everyone recognized that this is not something that's going to fix all the problems in the shelter overnight. We're hoping that this is one step of many that will help us strengthen the shelter in an effort to achieve a no-kill status in the San Angelo. But this is a lengthy process. And what we're hoping to do is take this baby step and grow that into something that is a multi-faceted approach to the problem. As we've learned year after year, you can't kill your way out of our population problem, but we also can adopt our way out of it. So we're going to continue and move forward with the importance of spay-neuter in education. But part of what's important to me about this RFP is the working together with the shelter and offering the citizens options, such as referrals to training, food bank access, things of that nature to help them empower them to keep their pets, honor their responsibilities instead of just a quick surrender. So I just want to be very clear and honest and transparent to you in telling you that this isn't a year from now. You're not going to have adopted all the animals out of the shelter and we're all going to be standing around talking about how great we are. This is a process, but I think it is an important first step. And I just want to make sure that as we move forward, everyone is supportive of this and has our eyes open to what we're doing because your support means everything to us as we move forward because this is a community problem and is

The hardest thing for me to do is to go to the shelter. And Harry Al holds your hand if you want to go through. The progress that's been made is phenomenal. The cleanliness, the care of the animals, and I really commend Mr. Flores for his leadership. I have a question, will that $60,000 cost the city more money in this plan? No, ma'am. Currently within our budget, we have found or through working with Michael and Bob, we're not asking the city or the general fund for a dollar. This is all internal monies that we have been able to change. The majority of it being chemical and medical, as you well know, we no longer have a veterinarian, so we're going to cease doing surgeries out at the shelter. We performed a little over 1,000 surgeries from February to December, but that process has been put on hold. So the majority of that money is going to come from that line, the chemical medical line, so it's not affecting the general fund at $1. With a public comment? Good morning. Good morning. the HRSA PC animal shelter advisory committee. This proposal did come by the advisory committee, which we voted unanimously in favor of.

[2:51:59] Personally, I'm very excited about this. I think that this really will give us the opportunity to help achieve our no kill status. I am just really excited to see what our animal control can do in terms of enforcing ordinances And I'm very excited to see what pause will do in terms of increasing our adoptions. And those two things are gonna be key for us to maintain a no-kill status. So personally I'm really excited and I hope that y'all vote in favor of this. Thank you. Thank you, ma'am. Good morning. Good morning, Director. My name is Michelle Stravak and I'm the Director of Cassie's Place. And I wanted to touch on a few things and then just kind of give some valid points that I feel and I believe some other local rescues do feel are worth looking into as far as moving forward with maybe approving or not approving or working this contract out. Cassie's place is a pending non-profit so that is one reason why we did not apply or put in an RFP on this issue. Had we been, which we are hopefully will be in the next month, we probably would have come up with a proposal to move forward and work with the city shelter to make the adoptions as well as volunteer programs. Cassie's place is a non-profit, rescue rehab rehome facility. We house typically around 30 to 35 animals. In more recent times we found ourselves to be housing more due to litters that are in the shelter as well as immediate injury or illness at the shelter that we are taking on upon calls from the shelter staff of you know saying hey we need this animal out immediately nine out of ten times we are there to help the animals that we are called upon. We have been a huge component in the shelters progress in the past year

[2:54:04] unfortunately due to us not being a 501c3 we have not been recognized as we should have been. We are a sister ship with a nonprofit in big spring so we are considered yellow rose that being said we have pulled in the past 15 to 17 days we have pulled 30 to 40 animals some being not even counted for at the shelter and because they were too young for their vaccinations and so forth speaking to the Mike, please. Oh, I'm sorry. For a shy of three years, our group of volunteers that before Cassie's was even a part or made a rescue, there's been a group of volunteers that we have worked with that have built a social media site called San Angelo Animal Shelter Run or Volunteer Run Page. And for those three years, we have worked vigorously in the shelter, taking pictures, making animals, publicizing them on Facebook, and getting to know the animals that are in the shelter. There was a short time frame when new management came in that we kind of stepped back a little and took a break, but as we do today we have volunteers that go out on a regular basis taking these pictures and promoting these adoptions. And I think that that's one of the main things that should be recognized that this can't be just one rescues entity taken on. I think that it needs to be a big collaboration of all of the rescues and partnerships. I'm sorry, horrible at public speaking, I apologize. It has been quoted that this is a mimic of the Austin No Kill after doing some research. I have not found many facilities that follow this type of proposal. And if a nonprofit does take over the adoptions in a municipal entity, they also take on the animal care vetting,

[2:56:06] feeding, and cleaning of the environment. the environment. I spoke with a representative out at hard luck, hounds in Austin, Texas where at one point it was quoted that this was kind of a mimic of the one minute. One minute. Okay. This was a mimic of and they said that there was not a nonprofit that was being paid or contracted to do the adoptions. Rather than focusing on one rescue to oversee adoptions, the focus should be on all rescues building an alliance, building a volunteer group that focuses on and the fundraising and adoptions and promoting of adoptions. Having the rescues work together and do exactly what the local rescues have already been doing. Our duty in this community is to get in there, be a servant to our community, focus on the uneducating, building awareness, and understanding, assisting the shelter where assistance is needed and building bridges between our citizens and our city staff. I would like to ask that an appointed community board of directors or representatives from all local rescues be involved in building this program if the proposal is approved. Just in the past week, James reached out to Sharon Hoffman at Crittersheck to try to reevaluate their relationship. I felt that making this positive effort as well as commitment from your local rescues as to engage our community in the adoptions, it would be in our best interest to make this a cooperative effort in partnership with all four local rescues. Having run Rescue Oversea manage and be accredited for adoptions while other rescues do their best efforts to help these community animals out of the shelter, you run into the problem of rescue funding. Though rescues all have the same goals, we do all run by donation as well as grants. Under this proposal, it is an assumption that Contravalli Pals will be counting each adoption as its own, as well as the nonprofit pools. We in nonprofits do apply for the same grants and this needs to be considered within the writing of the contract. And taking this- I mean, need to wind it up. Okay and taking this step forward by contracting and paying a non-profit 60,000 to run city

[2:58:13] adoptions, the community could lose sight of what a rescue truly is here for and what they're expected to do. This is your opportunity as council men and women to build an alliance with the local rescues as well as expecting more awareness to be put into the public about our animal where for by our community advocates as well as we all know you need to wind it up this is the last one as as we all know there is always a benefit in working in numbers rather than as one thank you very much thank you I have further public comment there if I could yes would like to I think that mr. Beck and all our other partner rescue should be commended for the contribution they make by adopt Helping to pull animals from our shelter and adopting them out. So thank you for your work regardless of how this vote goes Thank you for your work Love got some problems with this and In my 14 years I've dealt with four animal directors and never once have we taken public money and given it to someone that is in the business To sell dogs and Consul Valley Paul's sales dogs. Am I correct sales animals? You don't sell them at the mall? Yes, ma'am. No, sir. What we do is not consider selling dogs many of the adoption fees are waived depending upon what we're dealing with with the animal. Our adoption fees don't even touch our expenses that we have so we are definitely not-for-profit. The average cat we adopt out our average adoption fee is $85 unless we have a way to underwrite that fee. We have $118 invested in every healthy cat so if we get a cat in with upper respiratory worms whatever there's more invested so no it is not considered selling it is an adoption fee which is a donation and that doesn't even cover our expenses you

[3:00:13] do accept donations for animals at paid at your op at your place in the mall yes we do and we want out to pick out an animal it would cost me money depending on the animal depending on the situation yes we also transport animals out and sometimes our donors take on that fee to do that as well but it does cost to pick up an animal at your location depending on the situation of the animal. There are adoptions that are done that there is no transaction of money. But some do in the last year we have taken away the rights of the citizens of San Angelo to sell a dog or a cat in our said limits. We've taken away the rights of the people to be able to get rid of to get these animals into homes where they can be adopted. We Even we have began to charge at the animal shelter to accept any animal that is brought to our animal shelter. And this too will prevent people from bringing an animal in that can be adopted out. We no longer pick up captured feral cats. We have reduced our service. We no longer loan out the cages to capture feral cats, which is a reduction of service. And my constituents tell me that we no longer pick up the dead animals that are hit and killed on the street. I don't know if that's true or not, but that's exactly what my constituents are telling me. We are reducing services completely throughout our animal control. And now we're taking $60,000 of public money, and it may be in your budget, Mr. Flores, but this is public taxpayer money, and we are giving it to a private person, a private company. We're giving this money for them to run an operation that we have always ran and been able to take care of in the 14 years that I've been involved with this. And we are by giving an exclusive to Paul's, we're eliminating all others in this city. And Paul's does sell animals, whether they sell them or take a donation, it costs you money

[3:02:15] to get an animal from Paul's. And we're giving them the exclusive right to any and every animal that comes in our shelter and it eliminates all others. it takes $60,000 worth of public money and it puts it into the private hands and this also is not right. And if I'm the only way I would even consider approving this is a $60,000 reduction in the budget of the animal control. If they've got enough money, they can go out and start hiring people to do their work for them. And then maybe we're giving them too much to start with. Bill? Okay. I attended one of the outdoor exhibitions in front of Petzmer and I think it was in front of the Academy there. And I asked how much the animals were and they said $140. They didn't say it was a donation. And I saw the people from Pause sitting under shade and having their soldiers and ice water and stuff like that. And I saw those animals, dogs and cats, in cages, elk in the sun. On the hot asphalt, it was about 105 degrees, and they had no water or shelter, and they do charge for their animals. Okay? And also, on Facebook, when I brought this up, a pause denied that they had an offsite sale, that they had outdoor sales. Now, they've had quite a few since then. Okay, and also pause is putting animals in houses and neighborhoods, I don't know what you call them, halfway houses and those animals. I've heard from, I've seen myself and I've heard from other people, those animals are allowed to roam around the neighborhood. And I'm completely against using public money to support one group. And they do make their living by selling animals. Thank you. Just a couple real quick comments.

[3:04:17] First of all, when you talk about kids or pets, it's the most passionate thing people will have conversation about and you're going to have pros and you're going to have cons. RSTRs. That the bottom line is today, what's the next step in efficiency that Mr. Flores and his staff can take at the animal shelter? Personally, I think having somebody else run some of those other items so that he can put more people on the street to take care of the problems that we've got out there is certainly the way to go. And if it costs a little bit of money, then I'm all for it. Any other comments, Len? I want to disagree that something needs to be taking place at our shelter and help out the adoptions. The only problem I have is the exclusivity of it. It takes a village. that concept, I'd like to see as many people in entities to help out these adoptions instead of just one. I'm not saying one's better than the other at all but I would like to see as many people helping out our shelter as possible to get those animals adopted to the right families because like Harry said it is the most passionate thing we'll talk about. mess with my puppy that's all I can say is don't mess with my puppy but I will tell you that last month December and November I had 350 and 370 respectively dollars worth of vet bills for my puppy I do know that pause and the shelter the The requirements that we, the city, have approved, that they be spayed or neutered. They have their shots free of disease tags, whether it's the implants or all their necessary

[3:06:18] licenses and that costs money. And I don't think any agency can be expected to fund all of that without accepting donations or a fee to recoup what it costs to put that pet in a home instead of putting that pet down. It's, you know, I certainly didn't want to come up with $600 during the holidays, more better than $600 during the holidays, but I wasn't going to let my pet be sick. You spend the money, a responsible pet owner spends the money. And what we've been trying to accomplish out there for 15 years is to lower our kill rate, which ran over a thousand animals a month, close to 1,200 animals a month, which is disgraceful. I can't tell you how many times I called James when my pet disappeared for a week. You know, do you have my puppy? Do you have my puppy? frantic because someone took him out of the yard. I got him back. I'm thankful. I'm thankful for what the animal shelter has been doing out there. The work that I know that he puts in and staff puts in after hours, weekends. They can only do so much that they're physically able to do and have some sort of life and that they have the phones to do. And if he's got phones in his budget that are not being used that can assist those animals, we have it budgeted then why not use it? And that's how I feel. Okay, it was mentioned, okay, it's a village. But when the speed in a Newton's order, Newton's

[3:08:21] was pushed through, only one side was voiced. Now, the negative, okay, the opposition to that was not voiced, and there's a lot of reasons why speeding and noogering is not healthy for the animals, and it was against the wishes of the majority of the people in this city, and it's an invasion of the home, of people's rights. And I was gonna say something else but something that you mentioned but I can't remember right now. You know I love pets, you know I'm an animal lover and I just can't agree with this because you know they're using pets to make a living and make a profit off of it. I have any further comments I see some public comment and I will take them. But let's get through with the council first. Do I have any other further council comments on this? Yes, we're always looking for ways to try to reduce the kill rate. We're also always looking for ways to have these dogs adopted. And I am all for that. And like we always, we've been doing with the shelter. We're trying things out. So I think this is another thing that we need to try out. I just wanted to offer a few clarifications based on some of the things that have been said. There is no intent to block any rescue from being involved. We simply want to assist the shelter in taking the adoption process on. And that does include networking with area rescues but also state national rescues so so that we can continue to transport animals outside the area. Jennifer McCahn, who has spoke to you on the past,

[3:10:22] now lives in Washington and has done a phenomenal job setting up transport, so we want to continue doing that and networking with these rescues. We just want to be in the role where we are assisting animal control in doing this, so it frees them up to address some of the issues that you brought up today, may or such as the animals that are hit on the side of the road and left there, collecting the feral cats, so that they can actually focus on animal control and importantly enforcing the ordinance like the spany to ordinance that you brought up. The other point of clarification I just wanted to make is as we discussed on Facebook, Mr. Richardson, Concho Valle Paz doesn't have events at PetSmart, we're not a PetSmart Foster, so that's not a PetSmart partner. So that is not our organization that you've seen and I invite you to come to Sunset Mall and learn about what we do and how we screen our foster homes. I'm very proud of the program that we run. All of our animals, like Charlotte said, they're spayed, neutered, vaccinated, microchipped. We do everything we can to try to make sure that we're putting healthy pets in responsible homes. So I just wanted to offer a little bit of clarification. This is a no tent, no, there is no intent to phase any rescue out. We just want to help and be a part of the solution. And I think animal control needs, I think they need some assistance. They've done a fantastic job. And to the point you made earlier, the 14 years you've served our city mayor, you've not seen a proposal like this come before you. But I would also like to respectfully point out that you've also not seen a kill rate this low either. So I think that the animal control staff has done a fantastic job, but they have limited resources. And if we can be of assistance in that with manpower, possible volunteer programs, we want to, but we can't do it without support from the city. So thank you very much. Thank you, Jenny. Lane? Hi, my name is Kelsey Hall, and I'm the animal service manager at Cassie's Place. I do not know if you guys are aware about a year ago. We did have a pretty amazing volunteer program when the new management started. Now I do absolutely 100% applaud James and everything that the shelter has done. I know, personally, our director, Michelle Zerubak, works daily with many other people at the shelter. I mean, this month, we pulled a ton alone. However, a year ago, we did do the volunteer program. We helped. We had so many people that came out to the shelter on a daily basis, cleaning, walking. We even had dog walks, came out on Saturdays, which promoted adoptions. There were so many different things that you can do together, working together. And unfortunately, at that time, it was only two volunteer groups, West Texas AFA, Critter Shack at that time. Yes, Concho Valley Pals did come, and they've done an amazing job as they've done for many, many years. I'm not disregarding that at all. However, that had already been done with no pay, no kind of financial given. That's our job as a rescue community to do this for our town, like Michelle said, city servants. are servants to the animals. So I don't agree with one. I say we do it all. We do it all together and it was done very successfully about a year ago. Thank you. Thank you Mr. Flores. Well this contract is this a yearly renewable contract? Yes sir and the city has the ability to vacate the contract on a 30-day notice we can

[3:14:24] but it doesn't come up to with a renewal annually. Yes it does. Okay sir I'm sorry Okay, my question is with this contract, you're not going to prevent any Cassie's plays or Chris Shaq coming in and holding the volunteer days or anything like that. Just as recently as Friday, Michelle and I had a long meeting and it was a wonderful meeting. We came up with some new ideas. I need help with puppies and litters. That's what we're fixing to get. We get tons of them every single day and we're looking at the budget expense of inoculate net animal. There is an expense with that. It costs money to inject shots into an animal. And when they're litter-based, when they're under eight weeks old, we have to house that animal, and you're housing it, you're feeding it, you're disinfecting, and you've got manpower involved in it, only to sometimes it possibly gets sick. So we just looked into, I have not vetted it through the legal department yet, but our idea as of Friday, as recently as Friday with all this going on, was for the rescues, all of them, to pick up, I can pick up the phone and instead of in taking that puppy and giving it an injection, it's not going to work because it's not eight weeks old yet, I send it out of that facility. A city shelter has diseases, it just does. It always has diseases and it always will. We just simply are reactive in controlling the diseases that you, the people, bring in. So, it's a great idea. So, our vision is exactly that, is for this to get even stronger and grow even better. Is it new for City of Sanzo? Absolutely. after me being out there for almost two years, I think this is one of the greatest opportunities for all of us to finally come together, put any indifference aside, and let's get to work. If we're really here for the animals, then let's put it aside and let's get to work for the animals, and I think that includes everybody. Oh, it's almost in the sense that two of the employees at Pause will essentially become two employees without benefits of the city of San Angelo to help facilitate those animals for being adopted.

[3:16:26] Absolutely, without expanding upon, you know, with the recent Spanewter Ordinance, if you remember, that was passed. However, I wasn't granted billots to fill three positions that needed to perform that duty, a veterinarian, a vet tech, an assistant. So what did we do? We absorbed it internally. So something inevitably has got to suffer when we have to accommodate something else. This is the best proposal that I can think of whoever it be that got the contract. In this case, it's Paul's from a management standpoint because I can take two guys off of adoptions take a lot of time. It's very time consuming. You're vetting the animal with the customer. You're vetting the paperwork. We've streamlined that to the best of our ability. And what used to be a five page contract is now it's today just a one page contract. But there's still not enough time in the day with the influx of animals that this community has surrendered to us or is not taken care of. And when I looked up, this was the greatest opportunity for me to immediately get into the animal control business, which is what we should be in to begin with, not to say we shouldn't adopt and not to say we should have an 80% kill rate. I don't agree in both those statements. I think this is the best bang for the buck. Feral cats right now, in February of 15, counsel passed an ordinance that protected the animal. It's inefficient for me to go pick up a cat that's got a not steer or a tat on the belly. That's why we don't do that. But it's the perception of when we don't go that I want to be able to fulfill today because I've got a guy in the field, I can radio him, he can go talk to Mr. Carter and let him know, well, I can't take this one because Council's protected this through a colony cat ordinance. The day goes by, the perception is we didn't go out and it's really a very inefficient process for everybody. citizens as well. I'm a citizen when I leave that job and tax payers from all and you know I look at it from their shoes and I always do. I think I ran

[3:18:28] code the exact same way. So I buy it. I buy that. I think this regardless of who it is is going to really allow this city to move into core mission which is animal control. Like I've stated though you know one concern I had was the exclusivity of it with one company but as long as others can come in and help out. I'm all open for ideas. If it's an annual renewal contract, let's see how it works. Sure. And each rescue is niche oriented. They all take dogs, but some focus cow dog rescues a local rescue. They deal with cow dogs, you know, your healers, stuff like that. Not that they won't take a shitsu, but they predominantly are pulling cow dogs. Cassie's place, they are phenomenal with hurt animals with animals that require some serious vetting. Does one have priority over the other? Absolutely not. What we do, what we implement it to begin with to not selectively enforce for lack of better terminology, to not selectively choose, it's all about time. If now we're live on pet point, Patengo, you can sit there, they do it all day long. They know sometimes that when I got an animal and I don't know about it, that's how fast it is because we get an email, whoever's email comes first to cross my desk is the agency that's going to get that dog. And there's been not one obstacle with that process. And I think it's the only fair way to be it. If Michelle beats Jenny in a pool, she gets shitsy. And we go on. And they all understood that. They all agreed upon it. It got tested one time. And thank God we were stuck to our guns of fairness and equality. And the proof came out later that we did offer this person, because she sent the email before you did. The concern about the grants will pause have to be, they won't be able to claim those. No, those are city adoptions. When we apply for grants, there's several things that are reported.

[3:20:29] We report how many, we report how many adoptions we've done, how many dogs were shoulder dogs, how many dogs were foster dogs, how many dogs came from other sources. They're very, very detailed. And one of the categories on there is the number of animals that were transferred out to rescue. And so if we're working with another rescue, Cassie's Blaze, Crittershot, whoever, CowDawg Rescue, and it's an animal that they pulled, that's how it will show on our reports for our grants that we participated in that animal's rescue, but it was transferred out to another rescue. So then they get credit for all of those. So just because we were a part of it doesn't mean that we get credit for it under our adoption numbers. They're very, very specific in how they're categorized. Okay, I remember Ms. Farmer. I know some people have taken exception. Like everybody has different ideas, different beliefs. But just because somebody does not believe in speeding and neutering does not mean that they're not a responsible pet owner. And also with the $60,000, I would prefer to see it used to address the structural problems with the plumbing that they have built there. It's all that they can pass the yearly inspection from the state. And we do have structural issues. We've got some very serious issues. We've had them for a while. This is nothing new. The plumbing out there does not work. It is hard. We've gotten a bit of $135,000. And I'm glad you brought that up because as you and I discussed in our meeting there, that again is on me to look for that money. And we are confident that we have that as well. If you remember, we're not performing surgeries anymore. So there's a salary and some benefit amounts that have already been budgeted. We're prepared. I don't want to release that money because it's my budget that I try to operate underneath. But if I understand the economic demise that we're currently in as a city, we are confident that we can address that plumbing issue

[3:22:29] that we have with our current funds again, not going to the general fund. It's a taxation upon staff, but we're willing to do that. We've been taxed heavily in many capacities out there. I got a wonderful staff. And we're prepared to do that as well. So we can address our plumbing issues. We've talked about dividing it in halves, as Mike pointed out, which is a good idea. Take half this year, fix a couple of rows. Bottom line is, for every other row, you walk down my kennels that day, they don't drain. Every kennel has a peat trap, every peat trap's broken, and it's 18 inches of set, you know. What used to take two and a half hours to clean is about a five-hour process today. But we do have that addressed, because I'm not feeling the position of veterinarian right now. James, that's how you're funding these issues, is no more vet in the future in order to fund these issues. Absolutely, because although we are very proud and happy that we did over 1,000 surgeries in that short of time frame, while Dr. Nagaraj was here, our priority is we gotta get this plumbing fixed. And I know through talking with Daniel and Michael, that's tough right now from a city standpoint. There's bigger fish to fry for lack of better terminology. So we're prepared to take that money and hence not feel that position so that we don't burden the general fund. Okay, thank you. And you need to get more than one estimate from the plumber and if somebody doesn't want to do it, they're going to give you their don't want to do a price and somebody might be able to do that for half. Absolutely. And I'd like to congratulate you on the work that you've done out there. Thank you, sir. I appreciate it. I just want to add very briefly to what Harry said, and also what you just mentioned a while ago, you talked about core service. The core service for the city when it comes to the animal shelter should be animal control. We look at health and safety for the community. You mentioned a while ago your secondary mission is adoptions, but really for any city it's

[3:24:31] animal control and making sure that no one out in the community is ever placing any type of harm because the animal population has gone out of control. I do believe that what you're proposing at this point to outsource to a group that really is the experts in the area of adoption is exactly the right way to go. I've seen your people on the weekends and I'm very proud of them. I see them every time, whether it's a car show, whether you have it out, the animal shelter, you have those adoption situations going on every weekend. And I sometimes think, couldn't we use our staff more for the animal control version of it and allow a different group to come in and take care of that other part of it? I don't believe anyone here in the city council would say we want to do it with adoptions. But I agree with Harry. I think that we definitely want to make sure that we do everything we can to be efficient in doing so. And to outsource it, as far as I'm concerned, is probably the most efficient way to do it and allow us to concentrate on animal control. We vetted this thing a lot. That's item number E, it's considered authorizing the city manager to negotiate and agreement with I-10, race promotions and cooperative, DBA, Lucas, oil drag boat, race services, Series for the annual Craig Partush, drag boat races at Lake Nazworth, they execute any documents related there too.

[3:26:31] Carl, you have the force, sir. Yes, sir. We recently received a letter proposal from Lucas old drag boat racing. They want to continue the boat races here in San Angelo at Lake Nazworthy. They want to self-promote the event, basically organize it and run it all themselves. And they also want to host a second event in September. Just a quick brief background. This event's been going on for 10 years. It's held at Lake Nazworthy, basically Middle Consul in Spring Creek Parks at the latter part of June every year. There was one exception when the lake levels were very low a few years ago. They moved the event to September. The event's been very beneficial for the city and for Lucas. It does have an estimated economic impact of at least $2.5 dollars to the city with folks coming in from all over the country and the area to stay in San Angelo. We've once we got the proposal we held several different meetings with Lucas to discuss how they would move forward with this and at the last meeting we decided let's put this in the form of an agreement drafted up and take it to city council to see if they would consider this moving forward, letting Lucas self-promote the event at Lake Nazar in the form of agreement. Just a quick reminder, the event is held at Nalcancho Park here, also Spring Creek Park here, and basically folks come to stay at both of those parks during the event. The core area, of course, is right here. This agreement here the basic terms of it. What we drafted is a three year agreement with one option with an option to renew that agreement. There would be a flat rental fee for each event that they host. So if they decided just to host one

[3:28:33] event they would still have a flat fee for that one event. Basically just renting the park park for the event. They would self-promote the event each each event and we've been taking this bring this to council for the last 10 years every single year in the form of the through the special event process and we attach to that a supplement to that special event permit ordinance waivers the request to waive different ordinances so they can host the event and so those waivers of ordinances would be folded into this agreement and then we do know that Lucas and the chamber have been talking about what their role would be with the future events and we have representatives from Lucas Oil and also from the chamber here to answer any questions you might have. Staff does recommend we move forward with this agreement. How's chamber of commerce feel about it? Good morning Dan or good afternoon Dan. It was. Mayor Morrison, council members, staff, Dan Conig, I'm president of the San Angelo, Chamber of Commerce, just a little background in addition to Carl's comments. One, your agreements in the past were with the Chamber, who then in turn contracted with Lucas. So what you're hearing today is a is a change in direction from Lucas directly to the city. We've spent some time discussing this dissecting it the last several months, and if this is the direction that Lucas desires to go. We're extremely supportive of that. We are supportive of the races. We have been for the last 10 years. In fact, the chamber through its partnerships and the the reaches and the relationships that we've had have helped make the race what it is today. And I think it's in our best interest, you know, I look at that as equity. That we have a lot

[3:30:36] of sweat equity into this race. It's not a first year race. This is a mature race that over 10 years has become what it is. And so we have an investment in that race to see that it continues to be successful. Now that said, the chamber does stand to lose some revenue in this change of agreements, which I will just as needed. All the other reduced expenses or I'll raise more money. We had a committee that was organized that brought in about $200,000 in gross revenue, with which last year we had about a $20,000 net take. We put money into prize, purse monies, advertising, all those kinds of things. So what we'll do is we'll regroup and we'll look at how we need to move forward accordingly. But we are supportive of the races. We will have some questions in the future as to what role the chamber or CVB will have. But in the meantime, time we're supportive of maintaining the races here in San Angela. Real quick, Dan, from your perspective, the investment that the CBB put in over the last several years or each year as it was from a promotion standpoint. What do you think that may be? Oh boy, that's a good question. Well, number one, we dedicated staff time. So we have percentages of people that we contributed through the CDB. Last year, I know alone in promotional advertising, we spent over $65,000 in advertising. Now, that also doesn't take into consideration the partnerships that the Chamber established to secure over 110,000 in-kind advertising through local media partners. In all of that, then probably we'll be taken on by Lucas if they can self-promote. I hear the word self-promote.

[3:32:37] So really, as your chamber president, I'm looking at this as an opportunity. And you had before you today a wonderful showcase of our sports facility, some of the best in Texas. And so maybe this will free up some time and some talent, and maybe even some seed money, because that's we're up against in other communities. Other communities will offer seed money to bring teams and tournaments in. We have a very limited budget for that seed money. So maybe there are funds that have normally been allocated that we could direct to grow our room nights. A couple tournaments might generate as many room nights as the boat races generated and maybe in the end be more beneficial in terms of total economic impact down the road. But I want to make sure that that we do our best to grow those sports teams, too. And right now, I have, as some know, I have challenges because I have a limited bucket of sports funds that I can use to attract those tournaments. And as Charlotte and others know, those monies are almost already spoken for if we just renew last year's tournament agreements. So I view this as an opportunity or maybe to develop a new event or help other existing events grow, the rodeo, the stock show. So I think we'll sit back and we'll look at this and we'll re-evaluate and analyze, you know, our role in promoting heads and beds overall. Yeah, did you have a coming? Yeah, okay, there is, okay, like the economic impact was downgraded this year, I believe, from previous years. And I got this from you in your office there we had a meeting and okay you're estimated total attendance last year was 12,199 okay and then you come up with the impact of 4,080,000. What is that

[3:34:47] estimate based on? Well our CBB director is not here today but I believe it's It's an average, it's about $135 a day per visitor as a multiplier, without that sheet in front of me and having the math, I couldn't tell exactly, but I know that's been vetted pretty closely. I've looked at it a couple of different ways, and I think in general, just to put a parameter on it, I think you're probably looking at it somewhere between the three and four million dollar impact depending on how you want to use those economic measurements. I think it's safe to say there's probably a little wiggle room in any of those surveys to gauge that total exact impact. That was one of the questions that was brought up to me last year and it was criticized and it was dealt with. And also last year one of the criticisms about the boat races out there was the lack of policing, drunkenness, speeding, and disturbance in the neighborhoods. I don't think I'm the one who qualified to answer that question. Pardon me? I was not here for that race. I would have to refer to others or the chief if he's still in attendance for the address that issue. Other comments? I'm ready to move forward on this. I'd like to make a quick comment right before we move forward on this. Staff is supportive of this agreement, but I will say this, and you just mentioned a day, a little while ago, you guys have a lot of sweat equity invested into this deal. I know how difficult it is to establish a budget and forecast for that budget. And I know that you forecasted for this budget as well, this coming year for certain revenues that will be coming in. I would highly recommend for Lucas to really take this into consideration. I know that you do have a proposal for them. I would hope that somehow they can work with you this year to come up with a solution, something that actually would work really well for them as well.

[3:36:47] We're very supportive of the blood raises. But again, on our part, we're hopeful that they can work with you as well. Dale? I find it difficult that you're not willing to assure the citizens that there be proper policing there and that concern of yours. Councilman Richard, if this agreement goes through, which you're going to vote to authorize Daniel to execute. The chamber will have no role in this race. That would be a question for Lucas or your public safety officials. The chief is here. Could we ask him to address the problems that maybe they incurred last year or years before? I will tell you that we spent over $20,000 in hiring security in last year's actual expenses for the races private dollars just don't leave me I'm not aware of any major issues that have happened over the last several years of the boat races I think there's adequate overtime and officer that cover both the land and the water I can just go on the complaints that I received as a council person if there is a problem can you take care of it we can and I go out there regularly every year and then monitor those situations. As you mentioned it this item F&G are both related this is an amendment to the city's comprehensive plan amending the land use plan as as you mentioned and I'll give you a map to show that in just a minute and then the following case is the rezoning that is related to this this is the area you can see just off the loop it's there on bentwood and it affects at least this piece affects all the properties you see there in red although the zoning is just one one of those properties here you can see the area is designated general commercial currently and this is the future land use map you You can see the neighborhood center backing up to residential. Part of what this does is, obviously originally this area was considered for commercial, but you can see as the area is developed, the actual line of commercial comes back to this point. And so this is going to extend that commercial that's basically the front edge of the loop back to reflect that the development that's happened out there. And so this is the amendment, it would change all of this area, the commercial, this small area that's closest to the neighborhood would become neighborhood center, and then commercial

[3:43:03] here and then transitional. And part of the idea here is as you move back towards the neighborhood, it should be a little bit less intensive of uses. The kinds of uses up on the loop would be more intensive, but then as you get closer back back to the neighborhood, it would transition back to more neighborhood friendly uses. Rational for approval, it is consistent with what's out there in the development trends that are going on in the area. We did send out notices, did not receive any in favor or in opposition. Number G, and this is a partner to this, it's first public and first reading and public hearing for case PD1606, an ordinance approving request for rezoning from the general commercial CG zoning district to a planned development PD, zoning district to allow for all of those uses permitted in the neighborhood commercial CN zoning district, and the additional uses of warehouse and freight movement along the assembly of goods, generally located approximately 400 feet southwest of the intersection North bitwood Drive and Loop 306 on 1.30 acres. And this is a rezoning to rezone this property from general commercial to a plan development. The primary reason for the plan development is the LED manufacturer at this location does have some, what could be termed manufacturing uses,

[3:45:05] it's assembly of parts, but that is generally not allowed in the general commercial district. Although we didn't want to, we didn't feel comfortable that close to the neighborhood, rezoning it to a pure manufacturing or industrial district. And so the plan development allows them to do the specific use that they need on the property without opening it up in the future to more heavier industrial type uses. Again, this is the current future land use map, although you just recommended changing it as was noted in the previous case that is reflected right here. And so with the change you just recommended, this proposed zoning for this property would be consistent with the city's comprehensive plan. Again, the reason this came forward was the proposed expansion of their facility with a second building on the site. It is compatible with our plans and policies and the zoning ordinance, as well as being compatible with the surrounding area. I won't read through all of these, but again, all of our analysis found that this is consistent with all of the things that we look at in terms of a rezoning. We did send out notices, did not receive any responses in favor or an opposition. Again, the Planning Commission also recommended approval of this unanimously. Staff does recommend approval with some conditions, the pretty basic common things that are consistent with the development plans for the site from the applicant. This particular project was brought to our attention through the school S.A.I.S.D. had requested a change, let me see if I can get to this, get it myself, here we go. The request was through them and it actually involves Fort Concho Elementary. It was one that currently that that particular school is seven to four right now, one way during school days. And they had requested, we looked at this, done some traffic counts, kind of looked at this, and they requested to change basically from Metcalf where it begins there, Washington wraps around the school, change it to an all-time, or basically a one-way all the time, all the way to Highland, and also implementing the signage changes. The real intent was to be able to do pavement markings that would be there, you know, not temporarily, but would be there all the time and to address that. I think that was a concern of theirs, trying to get traffic through there with three lanes going one direction during school hours and I believe the main intent was if we could put down permanent pavement markings to help you know people through there they wanted that one way so that was kind of where we were and just to give you a little bit of background currently this is is what we were talking about so you come across Oaks and it it begins the one way now from

[3:49:07] seven to four come all the way down to where you hit bird just wrap around in in front of the school there and head towards Highland. And currently, of course, it's a two-way stop condition that we would be changing if we implemented this. And then what we're presenting is to basically make the one-way continuous all day, every day, from Metcalf, wrapping around the Highland. So what you see in the green there would be what's actually changing, or what's changing the ordinance. you have any problem with that now I've had I've been worked with school district and Lori Barton on this probably for three or four months AJ Turner from school district is here if you got any questions from him school district is signed off on the cost for this forty six hundred or whatever that number is yes or approximately yeah oh I think it's good and I'll move to approve it's presented. Continue, Ryan. Sir, what we've got to present today and the recommendations I'll get to at the end, but What I'd like to kind of start off with is give you a little bit of background. I'm not sure how many of you guys are familiar with the traffic system we have in place, which is

[3:51:07] very limited. Kind of what we're working off of, as you can see, the system is no longer supported, it's based in a Windows XP environment. So about 2012 is when that environment was kind of done away with. But as far as the components that control the intersections, as we move forward with with the bond projects, they will not talk, and they will not work with the new signals that are going in, and so this is something we're trying to be a little proactive and kind of get to in advance, as well as the existing communication system that's in place now is obsolete and at times non-responsive. As far as the street bond improvement is part of the roadway infrastructure, is how this is looked at as far as signals goes. With the five new signals approximately in the next 24 months, we'll be having five new signals come online, two on MLK, and then there'll be two on Bell, and there's a text dot-server way project that's actually ongoing as we speak, that will be actually taking in a new signal with that and the maintenance of that. And so as far as that goes, we've got corridors, and want to speak about corridors. I'm talking about Nickerbocker, Bryant, Sherwood Way, or our main corridors where we see heavy traffic, and we have about half of the signals in the city on those three major roads. And so communication with those is a paramod that needs to keep happening. We need to keep moving people down the road. In this system, we'll actually control these and future intersections as we get online with the bond projects. So the goals for an advanced traffic management system or an ATS, ATMS system, is to increase our efficiency as far as our roadway moving people down the road.

[3:53:07] I think that's important for the citizens. It enhances our mobility for trucks coming through and it improves safety of our roadways. And actually just kind of as a buy note here, we've got, in Texas, this particular system, there's about 230 agencies that use this now. have some sister cities that I've I've noted on here Odessa and then of course Lubbock is is fairly close to us but a lot of a lot of the municipalities have gone to the SNO Abilene's implementing some things right now with their signal systems. Just to give you kind of a brief overview of what it looks like once it's up and functioning this is from basically a desktop perspective we're able to look at it from an overview see what's going on in the field if we need to make adjustments and it helps us be a little bit more proactive. Now we rely on the public to call us if we have a signal in flash, you know, if something's not functioning properly, you know, it's up to the citizens to call us. We really have no way of knowing, you know, if the detection's working or not at this point other than, you know, with the kind of boots on the ground. So to kind of back that up, as far as what this system gains for us as a city, it gives us the full control like I've mentioned of all of our intersections, I could read down through these, but basically the instant notifications and the control of what's going on out there now that we don't have that capability is really a huge move forward for us. When we see issues going on we'll be able to hopefully respond immediately. It has the ability to send you a text or an email when an intersection is having an issue. If it's in flash or if there's something we need to deal with immediately. And it's always continuously scanning. And it basically saves time, like I mentioned, boots on the ground. If some of my staff is on call, they can take a laptop home. And majority of the issues that come up

[3:55:08] may not require going out into the field in the middle of the night to fix that. They can flip up on a laptop, make the adjustment, reset things from there, control it, implement you know quick safety fix hopefully. So the real question is and this is kind of light-hearted this is Sherwood way on a Saturday not really but do we do we really need functioning signals and I think it's something really important we need to consider as we move forward with the bond project and so our recommendation staff recommends awarding the by-board contract for two hundred sixty four thousand four hundred sixty four dollars to paradigm for and that's included software controllers and a maintenance agreement for the software and just to kind of note on this, this is the core system and this is why we're bringing into council to let you guys you know see kind of where we're at as far as moving forward but also to make you aware that there is about a approximate hundred and two thousand dollars for the communication side and those other things that will need to purchase to get this you know up in function but it won't be be something, these be brought to council, they're on by-board purchases under $50,000 or so. You want us to start? Well, here, Bill. I think this is something that's necessary that we're gonna have to do, so I move to approve as presented. Okay. It's about right now we're functioning in the way I'm SA and I won't get into all that but we're supposed to have one more traffic signal mechanic based on the amount that we're maintaining which we do we do not have right now we do have kind of a float position we try to cover that but this implements something that you can have basically reduced staff so there's a staff cost savings versus to the resets what we run into a lot is when we lose power downtown or when we lose power some of these intersections the time spent and it's approximately about a month and a half years what I look back on over the last three years is basically a time savings of manpower vehicle usage going out there resetting time clock so that things are functioning and so it removes that aspect in total and then about 60% of our other calls and concerns can be handled from the office so you're you're pulling back that time and that's approximately about $50,000 a year as far as departmental you know public comment on this item the call for the vote all in favor of approving this is presented please say aye aye opposed may thank you item number M is consider a resolution requesting the Texas state legislature take action to approve legislation regarding a handheld wireless communication device for text-to-base communications while operating a motor vehicle. Who's getting this one? This is just a resolution supporting legislation that was introduced by Representative Craddock that deals with a statewide texting ban. It was something we discussed when we passed our ban indicating you know at that time we said it's never passed the state before we're we're gonna do ours until the state takes action. This was requested by myself and also council member farmer. And I guess what this is, there's a resolution that we as a council that we recommend the extension of I-27. I-27 runs from Lubbock to Amarela and then back to Lubbock. And there's proposal out there to run I-27 down the porch of the plain corridor, which would be down 87 to connect with 20 in Big Spring, run on down to Sonora and connect with I-10 in Sonora, running through San Angelo. Its interstates are far safer than anything we have here, plus the economic benefits. And the county has already signed this resolution as the Chamber of Commerce. And I would like for the City of San Angelo to also sign a resolution asking text dot to look into the ability to go ahead and extend the I-27 on down through and down. Martin, you are on, ma'am. Good afternoon, Mayor and Council. What I have before you today is our first round at fee review. So we implemented a new process in the finance department for the annual permitting of credit access businesses. We're proposing implementing a fee of $25 that's largely based on our estimated cost of service at $23.32. We do think that with about 15 businesses in town that that would yield about $375 in new revenue

[4:01:15] for the general fund. We also did a survey of our peer city's colleagues that had also adopted the same credit access business ordinances we had. So you can see that we're on the low end, their only long view is cheaper than us, but again, that's largely driven by our cost to provide the service. So that's what's, it's only one item before you day to propose $25 for the credit access business. But take it. Move to approve as presented. The first here is within our budget, but it's editing Exhibit D of the budget ordinance to add a plans examiner position. is just housekeeping to get that existing position

[4:03:15] added to Exhibit D in the budget ordinance for the staffing levels within our existing budget. The next item before you is a recreation tournament team entry fees. We won the bid on a basketball tournament to come. So it's revenue of $25,500 and expensive $18,987. So that's actually a revenue over expenditure for the general fund of $6,513. The next item there is group insurance for general fund dependent funds. So this is as approved November 15th by the council. We as a general fund, we support funds such as the grants for contro fund, cemetery fund, sports complex fund. So this is simply getting the money out of the general fund into those funds as we do with our normal participation of those funds, we just simply didn't have that information before the budget was adopted. Additional WIC funding, we have an additional amount for the WIC grant from the Department of State Health services of $25,152 to reinvest in WIC programming. The next item there is the L3 Hang release at the airport increase. The original agreement was approved August of 2006, but when it went to rates and charges that did yield increased revenue for the airport fund, much needed revenue for that fund of $36,856, proposing putting all of that in maintenance for the airport, they really had to slash their budget this year to stay in line with their revenue. And the next item there is an airport skid steer purchase. They had auction proceeds that were un-budgeted at $31,427 and needing to replace a piece of equipment that they have in their fleet. And the last item before you is animal services donations for medical supplies, a revenue of $10,000. We received a citizen donation, specifically for spay neuter of $10,000. And so that will allow animal services to comply with the citizen's request on that. So that is the total expense of $137,589. Those of you who have been too quiet today,

I'm on I want good news. All right so good afternoon mayor council city manager I just wanted to give you a quick update on the performance of sales tax revenue this fiscal year. You know that we budgeted very conservatively this year however we're still having a little bit of concern about the trends we're seeing. As you can see in October we were very slightly up at 0.39% of an increase over that same month last year however November and December we did see double-digit decreases over the same month last year of 10% and 18.7%. So in December we started getting concerned I spoke with Daniel we decided to be very proactive early on this year to make sure that we mitigate any deficit that we see there to the general fund. We've been meeting with directors and managers, everybody's aware of what were, you know, what's going on, everybody's tightening their belts and Daniel has been very proactive and very involved in those discussions. I will say that in January we did see a slight increase of 4.3% over the same month last year. However, year to day our budget is still short by $311,000. So with that, I'll answer any questions that you have. Like I said, we're being very proactive. Daniel has requested that all directors, you you know, provide ideas for cost-saving measures, revenue increases, things like that. And so we're pretty certain that we'll be able to mitigate that deficit. Again, if you have any questions, we'll be happy to answer.

[4:07:15] Marty? Well, only in the business, when we're down revenue and having to tighten our belt, I was thinking about this last night. And I think it's good if we lead by example, if we're going to ask departments to find ways to save money, and we probably need to start from up here. I know we have a small budget, but maybe we should start our lunch or something. I'm on the support of that. And none of us got on the council to have our lunch So we all throw in to the teal, and we definitely do appreciate that. We have been meeting as Tina mentioned a while ago with directors. As a matter of fact, we have another meeting tomorrow afternoon. We have a lot of great, many ideas that came through last week as well. I really don't believe the city manager that I should go to every department, say each one of you is going to cut your budget by 10%. Because some departments, I mean the fixed costs of some of these departments, especially with the staffing and so forth is so high that unless the only way they could do that is either cutting services or cutting staff. So really what we approached it with, we're going to tackle it with different ideas that the staff came up with and there's a whole bunch of them. We'll be addressing tomorrow and we'll make absolutely sure that we do reduce our expenditures to make sure that we do not fall behind this year. So again, I just want a team to present this so that City Council would be aware of what we're dealing with right now, but we are very proactive. We're going to make sure that we stay ahead of the curve I did read in the middle of the paper the other day that Midland sales taxes are finally coming up again and they were very optimistic so hopefully things are going to start going north again instead going south. Sure. Be optimistic but cautious. Absolutely. And I think we've done well and we've been a lot worse shape had we not built this into

[4:09:18] our budget set realizing that things that go up can come down. you can still afford to murder the cream pie. I'm gonna hang on to my stickers bars while I got the opportunity.
